CASE # IOA <br /> <br />PUl~LIC HEARING AND LEVY OF ASSESSMENTS FOR <br />PAST-DUEiCHARGES ON MUNICIPAL UTILITY BILLS (WHICH MAY <br />INCLUDE W~TER, SEWER, STREET LIGHTING, RECYCLING CHARGES <br />AND PENALTIES INCURRED) <br /> By: Jessie Hart, Finance Officer <br /> <br />Background: <br /> <br />The City of Ramsay has been billing various services via the utility billing for several years. While <br />the City Code hasi allowed some method of collecting delinquencies, such as water shut-off, the <br />City has never exercised its option. In 1994, the City Council passed Ordinance g94-13, known <br />as the Current S .e~rvices Ordinance, which provides the ability to certify delinquencies to the <br />property taxes as ~issessments under Chapter 429 of the Minnesota State Statutes. <br /> <br />At the September 12, 1995 regular meeting, the public hearing for the above proposed assessments <br />was scheduled fo.i' Tuesday, September 26, 1995 at 7:00 p.m. The public hearing notice was <br />published, and, in accordance with Ordinance #94-13, notification was mailed to all properties <br />having delinquencies as of September 1, 1995. The original amount of all delinquencies was <br />$98,526.31, of which approximately $20,000 had been collected as of Friday, September 22, <br />1995. With this b~ing the first time the City has opted to certify delinquencies, it is anticipated that <br />there will be a number of residents at the public hearing. <br /> <br />We are being prOVided with weekly updates from Anoka Electric Cooperative as to payments <br />received towards ihe delinquencies. A number of payments are being received, net of penalties <br />incurred, leaving a~ relatively minor balance in the account. It is staffs position not to certify these <br />penalty amounts, §ut rather include them on the next quarterly billing as the beginning balance/past <br />due amount. <br /> <br />Upon adoption Of the resolution certifying delinquent charges as assessments against the <br />properties, the property owners will have 30 days to pay the past due amounts without incurring <br />certification char.~es. Those payments must be received at City Hall by the close of business on <br />October 26, 1995! or the delinquent amount will be certified to property taxes payable in 1996. <br />The certification ~tmount will be a one year assessment and will include a $10.00 administrative <br />charge and interest at 10.75 percent from the date of adoption to December 31, 1996. <br /> <br />Council Action.~ <br /> <br />Motion to adoptI Resolution #95-09-XX Adopting Assessments for Past-Due Charges on <br />Municipal Utility Bills (Which May Include Water, Sewer, Street Lighting, Recycling Charges and <br />Penalties Incurred). <br /> <br />Reviewed By: <br /> <br />City Administrato~ <br />Finance Officer <br /> <br />CC: 09/26/95 <br /> <br /> <br />
