Serving or selling...CAN...make you liable. Even in states where no "dram shop" laws <br /> are now on the books, common law as determined by court decisions can assign liability in <br /> any particular case. <br /> <br />2. FALSE. Again, common law as determined by court decisions can fix liability on servers or <br /> sellers. Serving "too many" drinks in too short a period of time, or encouraging obvious <br /> intoxication can increase your liability. <br /> <br />3. FALSE. Sometimes behavior becomes less inhibited, but as a drug, alcohol actually depresses <br />the nervous system. Severe toxicity can lead to a stupor, coma, and eventually death. <br /> <br />TRUE. Coffee, a cold shower, and other "remedies" do not effect one's Blood Alcohol Level, <br /> which is percentage of alcohol in the blood. <br /> <br />5. TRUE. Other factors might also be: male or female, food in the stomach (slows down rate of <br /> absorption), emotional factors, and most of all, TIME. <br /> <br />6. TRUE. The body eliminates alcohol at about the same rate for everybody. The figure of .01% <br /> per 40 minutes is a consistent rate for the body to process alcohol. In calculating BAL and <br /> determining if another drink will exceed the. I0 (or any other) level, the important point is <br /> that only the passage of time reduces BAL. The rate the body handles alcohol is <br /> equivalent to about a drink an hour. <br /> <br />7. FALSE. These behaviors are usually demonstrated with a' much higher BAL. <br /> <br />8. TRUE. Study and learn to recognize other signals included on the <br /> list on Participant Page 5 of these hand-outs. <br /> <br />9. TRUE. It is designed to <br /> protect everyone involved with the decision-making process, and it also gives support to the <br /> server. No one knows where the customer has been after leaving for a while. Documenting <br /> problems using the incident report form will also help to communicate with other employees <br /> so they can avoid serving or selling alcohol to someone who has already been "cut off." <br /> <br />10. FALSE. Starting with "You...," is poor because it puts the customer on the defensive and sets <br /> up a power struggle.
