Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, LaDae, and Terry. Voting No: None. Absent: Commissioner Thomd. <br /> <br />Case #2: Re'quest for a Conditional Use Permit to Grade and Export Soils; <br /> Ca'se of Good Value Homes, Inc. <br /> <br />Zoning Administrator Frolik reported that Good Value Homes have applied for a conditional use <br />permit (CUP) to gade and export soils from what is proposed to be platted as Chestnut Ridge 2nd <br />Addition in order to create more attractive building sites. Said development received preliminary <br />plat approval from the City on August 22, 1994 and consists of 65 acres proposed to be <br />subdivided into 72 single family lots. Ms. Frolik explained that the applicant is proposing to strip <br />the topsoil, remo~,e and export approximately 15,000 cubic yards of materials, and replace the <br />topsoil. The appli~cant proposes that the material would be removed from the site by hauling belly <br />dumps south on Pbtassium Street and west on 145th Lane and Sunfish Lake Drive to Sunfish Lake <br />Boulevard, and then the empty trucks would return to the site by going north on Tungsten Street <br />off County Roads#II6, east on 143rd Lane and north on Potassium. Due to the substantial <br />number of homes ~existing on the proposed ingress route, City Staff is recommending that the only <br />haul route be that Which has been proposed by the applicant as the egress route. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Motion by Commi~'ssioner Deemer and seconded by Commissioner Holland to accept gl through <br /># 12 as presented. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, LaDue, and Terry. Voting No: None. Absent: Commissioner Thomd. <br /> <br />Commissioner D~mer commented that the decision on the hauling route has great bearing on how <br />the remainder of the facts are approved. <br /> <br />John Peterson, Good Value Homes, responded that it would be difficult to ingress and egress on <br />Sunfish Lake Drive because it is narrow and lined with trees on both sides. He reported that there <br /> · <br />is a company antarested in the material being hauled, and they feel they could possibly provide <br />flagmen or people on hand-held radios to direct traffic. He suggested taking the proposed egress <br />route and devise a, system for traffic control so that the trucks do not meet on that road. <br /> <br />Commissioner Deemer confirmed that there is approximately 700 feet of road where the trucks <br />cannot meet. <br /> <br />Commissioner Holland inquired if the' applicant had any other objections· <br /> <br />Mr. Peterson replied there were none. He agreed that the only other option was to go through an <br />existing development, and using only the proposed egress mute will impact fewer people. <br /> <br />Motion by Comrrfi~'ssioner Deemer and seconded by Commissioner Holland to amend #13 through <br />#19 in the affirmative. <br /> <br />Further Discussion: Commissioner Deemer noted for the record that there were no objections from <br />residents on 146tli Lane and "he owns the rest." <br /> <br />_ <br /> <br />Planning Commission/August 1, 1995 <br /> Page 3 of 6 <br /> <br /> <br />
