./ <br /> <br />Owner ReSponsibility <br /> <br />PROPOSED AMENDMENT TO RAMSEY SNOWMOBILE <br /> ORDINANCE 6.0~ <br /> <br />The registered owner of every snowmobile operated in the City of <br />Ramsey shall be responsible to ensure that the snowmobile is <br />operated in accordance with the provisions of this ordinance. The <br />owner shall be presumed and deemed to have given consent to, and <br />shall be re~sponsible for, any violations found to have been <br />Committed by the operator of a snowmobile provided that the <br />following conditions are met: <br /> <br />First Violation <br /> <br />If a .~nowmobile is observed being operated in violation of this <br />code, and a .documented complaint is received from a responsible <br />person, or persons stating the violation and listing the Minnesota <br />Regist~ationl Number of the snowmobile in question "or otherwise <br />providing evidence of knowledge of ownership of said snowmobile", <br />a warning letter shall be sent to the registered owner of the <br />snowmobile s~ating, substantially, as follows: <br /> <br /> A snowmobile registered in your name was observed in violation <br />of the Ramsey City Code, specifically: Date: <br /> Nature bf Violation: <br /> <br /> Under Section 6.04.01 of the Ramsey City Code, the registered <br />owner of any snowmobile seen operated unlawfully is responsible for <br />the violation. If a second violation is observed' in the next <br />twelve months, the violation is a misdemeanor, punishable by up to <br />ninety (90) days in jail, a $700 fine or both. Subsequent <br />violations m,ay also result in 'a forfeiture of snowmobile operation <br />privileges in the City. This letter will be your only warning. <br />Sincerely: <br /> Title: <br /> <br />Second ViOlation <br /> <br />If a second violation within any given twelve month period occurs, <br />the violation shall constitute a misdemeanor as that term is <br />defined by Minnesota Statutes. The registered owner of the <br />snowmobile shall be deemed to have consented to the commission of <br />the misdemeanor and shall be prosecuted accordingly. <br /> <br />City Permit'Required <br /> <br />Notwithstanding the outcome of any criminal prosecution, if a <br />snowmobile is observed being operated in violation of this Code on <br />two occasions within any given twelve month period, the owner of <br /> <br /> <br />
