I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />'1 <br /> <br />CASE # <br /> <br />REPORT ON SECTION #22 DRAINAGE <br />By: Steven Jankowski, City Engineer <br /> <br />Background:.' <br /> <br />On March 14~ 1995, the City Council authorized Improvement Project g95-12 which <br />addressed dr ,a~nage improvements in Section #22. This project entailed a number of <br />construction elements and the creation and acquisition of easements to protect the drainage <br />rights throughi the drainage way from 156th Avenue south to the protected Wetland #656 <br />which is soutt/of 153/155 and then northward to County Ditch No. 3. <br /> <br />All five of the construction elements were completed by April except the installation of <br />culverts through Mr. Lewis' duck ponds. This could not be completed until Mr. Lewis' <br />birds were through the nesting season. The culverts are presently being installed as this is <br />being written, iAll of these improvements were installed with the verbal permission of the <br />landowners. <br /> <br />The other element of this project was to obtain easements to secure drainage rights through <br />the towage. <br /> <br />A drainage e~sement plat was prepared and submitted to the County in June 1995. <br />Following renew and revisions, the Drainage Easement Plat No. 1 was recorded on <br />September 29,! 1995. The Easement Plat became the legal description for the easements to <br />be required. <br /> <br />On or about OCtober 29, 1995, the drainage ditch which had been constructed through the <br />Stanley Welsc~ property had been filled in by Mr. Welsch. When I spoke with Mr. <br />Welsch about,this, he indicated that the ditch was a hazard to area children. I asked <br />whether it wo41d be possible to negotiate an easement over a portion of the property and the <br />subsequent cohversation led me to conclude this would not be possible. <br />Attachments: <br /> <br />a. Drainage easement Plat No. 1 <br /> <br />Proposed (~ou~'$e of Action to Complete this Project <br /> <br />At this point, I would recommend the following actions be scheduled and taken to bring <br />this project to Closure. <br /> <br />1. November~7, 1995: Sent letters to 13 property owners offering purchase of easement <br /> at $1,000 per acre. <br /> <br />November~ 14, 1995: Pass condemnation resolution attached to case seeking to acquire, <br />for drainage and utility purposes, the eastern 650' of the Welsch property. This is an <br />area of apl~oximately 1.34 acres of which approximately 0.75 acres is wetland. This <br />land would be used for drainage and wetland restoration to be used in the furore for <br />wetland b~king. ~ <br /> <br />November 16, 1995: <br />property. <br /> <br />Attorney Goodrich to file notice o.f.. condemnation of Welsch <br /> <br />/o! <br /> <br /> <br />
