REPI~ <br />CITY CO', <br /> <br />Background: <br /> <br />CASE # <br /> <br />AL OF SECTION 5.05 (CURFEW), CHAPTER FIVE OF <br />)E AND ADOPTION BY REFERENCE OF ANOKA COUNTY <br />DINANCE 95.2 (JUVENILE CURFEW ORDINANCE) <br /> By: Mike Auspos, Police Chief <br /> <br />Anoka County ha~ adopted a curfew ordinance that applies to the county in its entirety. This <br />means that, while.~e still would have our local ordinance, in all areas where the county ordinance <br />is more limiting, He county ordinance would prevail (see attachment of letter from Anoka County). <br />Several Metro counties have adopted this same or similar ordinance in order to make curfew more <br />standardized throughout the Metro area. <br />We have a few options to take, those being: to keep our present ordinance as it is and deal with <br />any inconsistencie~ between local and county as they arise; redraft a local ordinance in the form of <br />the county one ex,pt to use city-specific wording where applicable; or draft a new ordinance using <br />parts of local and dounty ordinances. One further option would be to adopt by reference the county <br />ordinance. '- <br /> <br />I f'md the county ordinance a very reasonable one, from its Purpose clause all the way through the <br />Definitions, Prohil~ited Acts, Exceptions and Enforcement clauses. <br /> <br />Anoka County haa. also, informally, recognized the need for a central drop-off center for curfew <br />violators in order that officers are not tied up waiting for parents to come and pick up the violators. <br />While there is currently no action being taken on this, such a plan is considered for the furore. In <br />the interim, we plah to use the ordinance to regulate the presence of youths upon the streets and in <br />public places and .fin,ay conduct, as Anoka City has done, "sweeps" on selected nights. Then we <br />would have person,hel available at City Hall to act as monitors until parents can arrive. <br />Recommendatiop: <br />Staff recommendation would be to adopt the Anoka County ordinance by reference. The City <br />Attorney will have!comments on this procedure. Attached to this case are copies of the county <br />ordinance and Rarflsey's ordinance. <br /> <br />Council Action:i <br /> <br />Motion to introduce Ordinance 95-XX repealing Section 5.05, Chapter 5 of City Code and <br />adopting by refere~e Anoka County Ordinance 95-2, and setting a date to hold a public hearing on <br />Tuesday, November 28, 1995 at 7:00 p.m. <br /> <br />Reviewed by: <br /> <br />Police Chief <br />City Administrator <br /> <br />CC: 11/14/95 <br />/jmk <br /> <br /> <br />
