This financial guarantee shall be maintained at the City as l~ng as the conditional use permit remains in full fome and effect. The operato~ of the facility will provide a visual inspection of all trucks and remove any debris from them prior to the trucks leaving the site, and take precautions to prevent spillage fron trucks. The City m Ly initiate action to revoke the conditional use permit in accordance with procedures e ;tablished in the Ramsey City Code. . The failure ~ f thc City at any time to require performance by the permittee of any provisions hereof shall m no way affect the right of the City thereafter to enforce the same. Nor shall waiver by fl c City of any breach of any of the provisions hereof be taken or held to be a waiver of a~ ~ succeeding breach of such provision or as a waiver of any provision itself. If any provision of this CUP shall be declared void or unenforceable, the other provisions shall not be gffected, but shall remain in full force and effect. 19. The Permit~e agrees to connect to City sewer and water at the time sewer and water is extended to ~the area and herein agrees to join in a petition for such improvements provided such petiticln is not presented within 7 years of the City's acceptance of the required improvements to 143rd Avenue N.W. and Jaspar Street N.W. The City Administrator, or his/her designee, shall have the right to inspect the premises for compliance ~md safety purposes annually or at any time, upon reasonable request. 21. The Permitt~e shall be responsible for all City costs incurred in administering and enforcing this conditi6nal use permit. Said expenses shall be paid within fifteen (15) days of billing by the City ~nd failure to pay the City's expenses within the fifteen (15) day billing period will permitl the City to drawn upon any of the escrows required by this agreement for payment. ?he permittee shall maintain a $2,000.00 balance in an escrow account with the City. Thi~ escrow shall be used to reimburse the City for expenses incurred in the administration of this permit in the event the permittee fails to pay the City expenses within the fifteen ~lay billing period. The City reserves the right to use these funds to pay for testing servlces as necessary.
