Counciknember introduced the following resolution and moved for its adoption: RESOLUTION ~)$-11- A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST FROI~I NORTH FORK, INC. FOR A COND-rTi'0NAL USE PERMIT TO GRADE, IMPORT AND EXPORTS SOILS WHEREAS, the City of Ramscy received an application from North Fork, Inc. for a conditional usc perttfit to grade and export excess soils from the property legally described as follows: Part of Oufl0t C, NORTHFOKK ADDITION, Anoka County, Minnesota. (the "Subjec! Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAM~EY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact ~lating to the request are determined to be as follows: 1. That on April 28, 1987, a conditional use peri, it was issued to L&G Rehbein, Inc. and North Fork, inc. for the grading and excavating of a lake in the Northfork P.U.D. 2. That the permit issued in 1987 had no set expiration date and subsequent to its issuance, the City of Ram~ey amended its grading and mining regulations. 3. That on Ap.~ 23, 1991, the City of Ramey reissued the 1987 conditional use permit in accordance grith the revised grading and mining regulations. 4. That on August 13, 1991, the City of Ramsey approved transferring the grading and mining pernidt from L&G Rehbeing, Inc. to Glenn Rehbein, Inc. 5. That the pe rrhait issued to Glenn Rehbein, Inc. in 1991 contained an expiration date of July 31, 1992. 6. That on OctOber 26, 1995, the City of Ramey received an application from North Fork, Inc., herem~ter referred to as "Applicant", for the reissuance of a conditional use permit to exports soil~ associated with the completion of the lake excavation and revised lot grades for the creation of waik-out sites. That the ap~!ication received on October 26, 1995, included a Grading and Drainage Plan, attached hereto as Exhibit A, revised from that which was approved under the preliminary plat of No .r~hfork 5th Addition, and a Phasing & Sequencing Plan, attached hereto as Exhibit B, ~epared by Ulteig Engineers, Inc. dated October 17, I995. 8. That the Applicant appeared before the Ramsey Planning Commission for a public heating pursuant to $ection 9.03.04 of the City Code on November 9, 1995, and that said public hearing wa~ properly advertised and that the minutes of said public hearing are hereby incorporate~ as a part of these findings by reference. That the Subject Property is located in a golf come/residential area of a Planned Unit Development and the proposed area for grading is approximately eighty (80) acres in size. /O5
