Basically they recommend no <br />ditch block at loc4tion no. 1 due to the low elevation of many of the houses on ICrypton. It is <br />further recommen!ted that ditch blocks be placed at locations 2 and 3, with top elevations of <br />860.3' and 860.5' t/espectively. Finally, it is recommended that an earthen dike be constructed <br />with a top elevation of 861.0' at location no. 2 in the overbank area with riprap channel protection <br />immediately dowflstream of the dike. These recommendations are drawn on the enclosed cross- <br />sections. <br /> <br />We have also preqi.'ously discussed the statutory requirements for altering Ditch No.43. <br />~ffmnesota Statut&, Chapter 103E.227 in part states that <br /> <br /> "(a) To ~nserve and make more adequate use of our water resources, a person, public <br /> or munici 'p~al. corporation, governmental subdivision...may petition for the installation of <br /> dams or other control works in drainage ditch systems to impound or divert waters for <br /> beneficial Sse. The petition must be directed to the drainage authority where the drainage <br /> system Is located. <br /> <br />Co) The p~ition must contain the location of the installation, plans, and specifications for <br />the proposed structure and a map of the areas likely to be affected by the impoundment or <br />diversion. ~.. <br /> <br />Subd. 3.
