I <br />I <br />I <br />I <br />! <br />i <br />I <br />I <br />I <br /> <br />Alcohol Use -~the consumption of any beverage, mixture, or preparation, including <br />medication, confaining alcohol. <br /> <br />Appointing Authority - the City Manager or other City officer t° whom the manager has <br />delegated autho..i'ity to appoint personnel. <br /> <br />BAT (Breath AlCohol Technician) - an individual who instructs and assists individuals <br />in the alcohol te~ting process and operates an EBT. <br />Chain of Custo~ly - procedures to account for the integrity of each urine specimen by <br />tracking its hand, Jing and storage from point of specimen collection to final disposition of <br />the specimen. ~/ith respect to drug testing, these procedures shall require that an <br />appropriate dru..gl, testing custody form be used from time of collection to receipt by the <br />laboratory and tll)at receipt by the laboratory an appropriate laboratory chain of custody <br />form(s) account(i~) for the sample or sample aliquots within the laboratory. <br />City, City of BrOoklyn Park, or Employer - the City of Brooklyn Park, Minnesota, acting <br />through its cityManager or a designee of the City Manager. <br /> <br />City of Brooklyr[l Park Drug and Alcohol Testing Policy - a separate Drug and Alcohol <br />policy that is pa~ of the City of Brooklyn Park Personnel Rules. <br /> <br />Commerce - b~th of the following: 1) any trade, traffic or transportation within the <br />jurisdiction of the~ United States between a place and a state and a place outside of such <br />state, including ~a place outside of the United States, and 2) any trade, traffic and <br />transportation ini the United States which affects any trade, traffic, and transportation <br />described in number 1) of this definition. <br /> [ <br />Commercial Mdt'or Vehicle - a motor vehicle or combination of motor vehicles used in <br />commerce to trar~sport passengers or property if the motor vehicle; and 1) has a gross <br />combination rati,hg of 26,000 or more pounds inclusive of a towed unit with a gross <br />vehicle weight r~ing of more than 10,000 pounds, or 2) has a gross vehicle weight rating <br />of 26,001 or m~.re pounds, or'3) is designed to transport 16 or more passengers, <br />including the driver, or 4) is of any size and is used in the transportation of materials <br />found to be haz~. rdous for the purposes of the Hazardous Materials Transportation Act <br />and which require the motor vehicle to be placarded under the hazardous materials <br />regulations set f~. rth under 49 C.F.R. part 172, subpart F. <br /> <br />Confirmation Tffst - for alcohol testing is means a second test, following a screening test <br />with a result of .,02 or greater, that provides quantitative 'data of alcohol concentration. <br />For controlled s~bstances testing it means a second analytical procedure to identify the <br />presence of a slSecific drug or metabolite which is independent of the screen test and <br />which uses a different technique in chemical principal from that of the screen test in order <br />to insure reliabili,fy and accuracy. (Gas chromatography/mass spectrometry (GC/MS) is <br />the only authorized confirmation method for cocaine, marijuana, opiates, amphetamines, <br />and phencyclidin~e.) <br /> <br /> <br />
