Except as provided in paragraphs (b) through <br /> (f) of this ~ection regarding random testing, the minimum annual percentage rate <br /> for randorfl alcohol testing shall be twenty-five percent (25%) of the average <br /> number ~i driver positions the City has unless changed by the FHWA <br /> Administr~or. The minimum annual percentage rate for random controlled <br /> substance~testing shall be fifty (50%) of the average number of driver positions the <br /> City has u ~less changed by the FHWA Administrator. <br />b) Selection if Drivers. The selection of drivers for random alcohol and controlled <br /> substance testing shall be made by a scientifically valid method, such as random <br /> number ta ~le of a computer-based random number generator that is matched with <br /> driver's s, ~cial security numbers, payroll identification numbers, and other <br /> comparab? identifying numbers. Under the selection process used, each driver <br /> shall havelan equal chance of being tested each time selections are made. <br /> Number.o~ Drivers..Selected. The City shall randomly select a sufficient number <br /> of ddvers flor alcohol testing dudng each calendar year to equal an annual rate not <br /> less than the minimum annual percentage rate for random alcohol testing shall not <br /> be less th~.n twenty-five percent (25%) of drivers unless changed by the FHWA <br /> Administrator. For controlled substance testing, the City shall randomly select a <br /> sufficient 4umber of drivers for controlled substances testing during each calendar <br /> year on ad equal or annual rate not less than the minimum annual percentage rate <br /> of fifty J <br /> percent (50%) of drivers. If the City conducts random testing for alcohol <br /> and/or co4trolled substances through a consortium, the number of drivers to be <br /> tested ma~, be calculated for each individual employer or may be based on the <br /> total humidor of drivers covered by the consortium who are subject to random <br /> alcohol a~d/or controlled substance testing at the same .minimum annual <br /> percentage rate under this part or any DOT alcohol or controlled substance testing <br /> rule. : <br /> Notice Reeardin_~ Tests. The City shall ensure that random alcohol and controlled <br /> substance[testing conducted pursuant to federal law are unannounced and that the <br /> dates for i administering random alcohol and controlled substance tests are <br /> throughou~ the calendar year. Drivers may be selected for more than one test per <br /> year. <br /> Test Imm~jdiacy. The City shall require that each driver who is notified of selection <br /> for randor~ alc°hol and/or controlled substance testing proceeds to the test site <br /> immediately; provided, however, that if the driver is performing a safety-sensitive <br /> function a,t the time of notification, the City shall instead ensure that the driver <br /> cgases to ~erform the safety-sensitive function and proceeds to the testing site as <br /> soon as p~ssible. <br /> Timing of!Test. A driver shall only be tested for alcohol while the driver is <br /> performin~ safety-sensitive functions, just before the driver is to perform safety- <br /> sensitive !unctions, or just after the driver has ceased performing such safety- <br /> sensitive ~nctions or while the driver is in a state of readiness to drive. <br /> <br /> <br />
