The split <br /> specimenIshall be retained in long-term storage for one year by the laboratory <br /> conductin~ the analysis of the split specimen. <br />Reporting and Review of Results for Controlled Substance Testing <br /> <br />a) <br /> <br />b) <br /> <br />d) <br /> <br />Confirmation Test. The MRO shall notify each driver who has a confirmed positive <br />test that ~the employee has 72 hours in which to request a test of the split <br />specimen! if the test if verified as positive. The driver is responsible for all costs <br />associate~ with the confirmatory retest unless results are negative. If the driver <br />requests Tn analysis of the split specimen with 72 hours of having been informed <br />of a verified positive test, the MRO shall direct, in writing the laboratory to provide <br />the split sl~ecimen to another DHHS-.certified laboratory for analysis. If the analysis <br />of the splil Specimen fails to reconfirm the presence of the drug(s) or metabolite(s) <br />found in t~e primary specimen, or if the split specimen is unavailable, inadequate <br />for testin~or untestable, the MRO shall cancel the test and report cancellation and <br />the reasohs for it to the DOT, the City, and the driver. <br />MRO shall direct analysis of split specimen. If the driver has not contacted the <br />MRO witE!n 72 hours, the drier may present to the MRO information documenting <br />that serio~sl, illness, injury, inability to contact the MRO, lack of actual notice of the <br />verified I~sitive test, or other circumstances unavoidably prevented the driver from <br />timely cohtacting the MRO. If the MRO concludes that there is a legitimate <br />explanation for the driver's failure to contact the MRO within 72 hours, the MRO <br />shall dire4t the analysis of the split specimen, as applicable, be performed. <br />MBO Unj~ble. to Contact Driver. If, after making reasonable efforts and <br />documenCng these efforts, the MRO is unable to reach the driver directly, the <br />MRO mu~t contact the' designated City contact person, who shall direct the driver <br />to contactithe MRO. If the City contact person is unable to contact the driver, the <br />driver will[be placed on suspension. ' <br />MRO Ma~ Verify Positive Test. The MRO may verify a test positive without having <br />communicated directly with the driver about the test results under the following <br />circumstances: 1) the driver expressly declines the opportunity to discuss the test <br />results; 2~ the driver has not contacted the MRO within five days of being <br />instructed~to do so by the City. <br /> <br />Alcohol Testin.q ~ <br /> <br />The FHWA alcohol test rules require breath testing administered by a Breath Alcohol <br />Technician (BA~ using an Evidential Breath Testing Device (EBT). Two breath tests are <br />required to date ,r~ine if a person has a prohibited alcohol concentration. Any result less <br />than 0.02 alcohol concentration is considered a "negative' test. If the alcohol <br />concentration is i0.02 or greater, a second confirmation test must be' conducted. If the <br />driver attempts aJnd fails to provide an adequate amount of breath, the City will direct the <br />driver to obtain a~ written evaluation from a licensed physician to determine if the driver's <br /> J <br /> <br /> 12 <br /> <br /> <br />
