FEDERAL OMNIBUS TRANSPORTATION EMPLOYEE <br />TESTING ACT REASONABLE CAUSE PROCEDURE <br /> <br />Under provisions of the Act, the City may require an employee to undergo an alcohol or <br />controlled substance test based on specific, contemporary, articulable observation <br />concerning, the appearance, behavior, speech, or body odors of the driver. The <br />observation may include indications of the chronic and withdrawal effects of controlled <br />substances. <br /> <br />The following procedures shall be followed for testing: <br /> <br />Only a supervisor who is trained in accordance with federal law shall' make a <br />determination of reasonable cause. (HOwever, another employee may report <br />reasonable cause to a supervis.or.) <br /> <br />· Observations are made during,, just preceding, or just after the period of the work <br /> day. <br /> <br />· Observations are recorded on the Observed Behavior- Reasonable Cause <br /> Record form. <br /> <br />· Alcohol testing shall be administered within two (2) hours of the reasonable cause- <br /> determination. <br /> <br />· Controlled substances testing shall be administered within eight (8) hours of the <br /> reasonable cause determination.. <br /> <br />The supervisor shall arrange for an employee tested under reasonable cause to <br />report to the Brooklyn Park Medical Center at 5805 74th Avenue North (off Unity <br />Avenue or 74th), just behind the Village NorthShopping Center within the specified <br />time limit. <br /> <br />if the testing is not completed within the time stated, then a written report-shall be <br />prepared and maintained as to the reason(s) the test was not promptly administered. <br /> <br /> ! <br /> ! <br /> ! <br /> <br /> I <br /> I <br />! <br />] <br />] <br />! <br />] <br /> <br />! <br />! <br /> <br /> <br />
