Absent: CouncilmemberPeterson. <br /> <br />Case #3: '!lequest to Rezone Certain Property from B-3 Highway <br /> ~Business to R-1 Urban Residential; Case of Super Bowl, Inc. <br /> and Fitzsimonds Builders, Inc. <br /> <br />Zoning Administrator Frolik explained that Fitzsimonds Builders, Inc., fee title owner of <br />Super Bowl, ~c., applied to rezone Lot 6, Block 4, of Riverside West from B-3 Highway <br />Business to R-! Urban Residential. The Planning Commission conducted a public hearing <br />and recommenBed approval of the rezoning. Subsequent to the Planning Commission <br />meeting, it wa~determined that part of the Super Bowl structure encroached on Lot 6 and it <br />would be necdssary to replat the property prior to eliminating encroachments prior to <br />rezoning Lot 6.i The applicants have replatted the four lots the structure is located into one <br />commercial an~l two residential size lots. The application to rezone the remainder of Lot 6 <br />or the two residential size lots to R-1 Urban Residential has been reactivated under the new <br />legal description. The Planning Commission and City staff recommend approval of the <br />proposed rezofl~ing. <br />Motion by C°t!ncilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution g95-08-177 adopting Findings of Fact g0384 relating to a request from Super <br />Bowl, Inc. an~'_d Fitzsimonds Builders to rezone certain property from B-3 Highway <br />Business to R-ii Urban Residential. <br />Motion carrie& Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer and <br />Beahen. Votin~ No: None. Absent: CouncilmemberPeterson. <br />Motion by C0uncilmember Zimmerman and seconded by Councilmember Beyer to <br />introduce the o~dinance rezoning certain property in Riverside West from B-3 Highway <br />Business to R-I Urban Residential. <br /> <br />Motion carried~ Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer and <br />Beahen. Voting No: None. Absent: CouncilmemberPeterson. <br /> <br />Case #4: ~rderi.ng Improvement Project g95-16; the Bituminous <br /> Surfacing of Bison Street Northwest between 171st Avenue <br /> iand 173rd Avenue N.W. ~ <br /> <br />City Administrator Schroeder explained that the City has been talking about paving projects <br />relating to Bis(on Sue. et for a number of years. Council received a petition by three <br />properties on May 9, 1995. A public hearing was held on Sune 13, 1995, for the area of <br />Bison betweeni171st and 173rd Avenues. The cost of the project is $35,620 with the unit <br />cost being $4,937. Council has also received a pedfion against the project from three <br />abutting property owners representing 50 percent. As that is not greater than 50 percent, <br />ifs not sufficient to automaticallYstop the project Given the history of the project, staff is <br />recommending iordering it. <br />Motion by Cot~cilmember Beyer and seconded by Councilmember Zimrnennan to adopt <br />Resolution g0~-08-178 ordering Improvement Project g95-16; bituminous surfacing of <br />Bison Street N~W. between 171st Avenue and 173rd Avenue N.W. <br /> <br />Larry Sanders; 117135 Bison Street N.W., Ramsey, stated that they have been fighting over <br />this project forieight years or so.
