Mr. Lewis indicated that the swans he raises in the pond were nesting and <br />could not be d~sturbed until after the cygnets hatched in June. Mr. Jankowski reported that <br />he had been l'e~aving messages on Mr. Lewis' answering machine since mid-June and had <br />not heard anyt!fdng back from him, until tonight. Mr. Lewis, who has been out of town, <br />has indicated .that he obtained the culverts and that he would install them himself. Mr. <br />Jankowsld anticipated Mr. Lewis' cooperation but stated he does not have a problem <br />asking for the ~option of the resolution to begin eminent domain proceedings anyway. <br /> ; <br />Councilmemb6r Beycr stated she thought Council had already adopted a resolution <br />initiating eminent domain proceedings for this project. <br /> <br />Mr. Jankowsl{i explained that Council adopted a resolution authorizing acquisition of <br />easements, not. a condemnation resolution. <br /> <br />Councilmeml~r Beyer inquired about not having the easements but commented that the <br />work is done. i <br />Mr. Jankowsld replied that was correct because we were given permission to enter onto the <br />property. H~ stated that several property owners did have concerns about granting <br />easements andlhe is not certain all will do so. <br /> <br />Discussion endued about condemnation proceedings and Council directed that Staff should <br />present resolu~ons pertaining to the remainder of the properties. <br /> <br />Councllmemb~r Beyer commented she would rather acquisitions were done through <br />negotiations i~tead of through condemnation proceedings. <br />Motion by Coqncilmember Zimmerman and seconded by Councilmember Beahen to adopt <br />Resolution ~)$-09-211 authorizing acquisition of property for drainage purposes subject to <br />the City Atto~ey's review of the legal description. <br />Motion carried.
