CASE # ~ <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: ~' <br /> <br />Luther and Nancy Olson are requesting a variance to construct an accessory garage nearer the front <br />property line than the principal structure at 14840 Bowers N.W. The'pm:eel is approximately 1 <br />acre in size and the Olson home is located approximately 78 feet from the centerline of Bowers <br />Drive N.W. They are proposing to construct a garage which will be approximately 67 feet from <br />the centefline of Bowers Drive N.W. City Code states that accessory structures shall not be <br />constructed nearer the front property line that the principal structure. <br /> <br />The following items are enclosed for your information: <br /> <br /> a) Site location map d) Proposed f'mdings of fact <br /> b) Application and Site plan e) Proposed variance <br /> c) Petition from neighbors <br /> <br />Notification: <br /> <br />City Code requires that requests for variances be subjected to a public heating. In the opinion of <br />City Staff, only the ~mrnediately neighbors are impacted by this request for variance and therefore, <br />only the property Owners within the standard 350 foot distance requirement were notified of the <br />hearing. <br /> <br />Observations: <br /> <br />City Staff has visited the site and conf'u'med that rear and side yards are not reasonable sites for <br />placement of the garage because of the locations of well, septic System, mature tree growth, and <br />uneven topography. <br /> <br />There is no existing garage on the site. The property owner has indicated that the principle <br />structure once was a one-room schoolhouse and understandably, the site was developed without <br />consideration for placement of a garage at some point in the future. <br /> <br />Staff Recommendation: <br /> <br />City Staff recommends approval of the request for a variance. <br /> <br />Board Action: <br /> <br />Motion to: <br />Adopt Reso!ufion ~95-05 adopting Findings of Fact # relating to Luther and Nancy <br />Olson's request for a variance to construct an accessory structure nearer the front property <br />line than the!principal Structure. <br />-and- <br />Motion to: <br />Approve/deny Luther and Nancy Olson's request for a variance to construct an accessory <br />structure ne~er the front property line than the principal structure on the property known as <br />14980 Bowers Drive N.W. and adopt Resolution g95-05- declaring terms of variance. <br /> <br />Review Checklist: Building Official <br /> <br />Bd of Adj: 5/24/95 <br /> <br /> <br />
