CASE # 1 <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE F1kONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br />By: Zoning Administrator Sylvia Frolik <br />Background: <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Jeffrey and Teri Wise are requesting a variance to construct an <br />accessory garage nearer the front property line than the principal structure at 7901 165th Avenue <br />N.W. The parcel is approximately 3 acres in size and the Wise home is located approximately 148 <br />feet from the front property line. They are proposing to construct a garage which will be <br />approximately 116 f6et from the front property line. <br />The following items are enclosed for your information: <br />a) <br />Site location map <br />b) <br />Site plan <br />c) <br />Proposed findings of fact <br />d) <br />Proposed variance <br />Notification: <br />City Code requires that requests for variances be subjected to a public hearing. In the opinion of <br />City Staff, only the i#nmediately neighbors are impacted by this request for variance and therefore, <br />only the property owners within the standard 350 foot distance requirement were notified of the <br />hearing. <br />Observations: <br />The site plan submitted reflects, and staff inspection confirms, that the side yards are consumed by <br />septic system, well,, and very mature tree growth. The rear yard consists of wetlands, sharp <br />declines in topography and substantial tree growth. <br />It could be said that the applicant created his own hardship when he placed the home 148 feet back <br />from the front property line. However, the lot is heavily wooded and has a substantial number of <br />mature trees; the decision on where to place the home was based on the desire to destroy as few <br />trees as possible. <br />Staff Recommendation: <br />City Staff recommends approval of the request for a variance. <br />Board Action: <br />Motion to: a <br />Adopt Resolution #95 -06� adopting Findings of Fact 4Q relating to the Jeffrey and <br />Teri Wise request for a variance. <br />-and- <br />Motion to: <br />Approve /deny Jeffrey and Teri Wise's request for a variance to construct an accessory <br />structure nearer the front property line than the principal structure on the property known as <br />7901 165th Avenue N.W. and adopt Resolution #95 - declaring terms of variance. <br />Review Checklist: Zoning Administrator <br />Bd of Adj: 6/21/95 <br />
