Board Member introduced the following resolution and moved for its adoption: <br />RESOLUTION #95 -06- <br />A RESOLUTION ADOPTING FINDINGS OF FACT RELATING TO A <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN At,'`ESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br />WHEREAS, Jeffrey and Teri Wise, hereinafter referred to as "Applicants ", have properly <br />applied for a variance from Section 9.11.02 of the Ramsey City Code to construct an accessory <br />garage nearer the front property line than the principal structure on the property generally known as <br />7901 165th Avenue N.W. and legally described as follows: <br />Lot 3, Block 3, Trott Brook Ridge, Anoka County, Minnesota. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of <br />the Ramsey City Code on June 21, 1995 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br />2. That the subject property is zoned R -1 Rural Residential and is approximately three (3) <br />acres in size. <br />3. That the subject property is surrounded by R -1 Rural Residential zoning. <br />4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br />5. That the principal structure on the subject property is located approximately 148 feet from <br />the front property line. <br />6. That the Applicant is proposing to construct an accessory garage approximately 116 feet <br />from the front property line. <br />7. That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the side yards are consumed by on -site <br />septic system, well, and substantial, mature tree growth and rear yard consists of wetlands, <br />heavy tree growth and sharp declines in topography. <br />8. That the special condition causing the undue hardship (a 148 foot setback for accessory <br />structures) was caused by the Applicant siting the home on the lot; however, there are a <br />substantial number of mature trees on the site and the placement of the home was based on <br />the least amount of tree removal. <br />9. That similar variances have been granted in the R -1 Rural Residential district in the City of <br />Ramsey. <br />10. That the variance requested is the minimum variance which would alleviate the hardship. <br />
