there has to be two publications, a feasibility study has to be done by the City Engineer and <br />then the Council can order the project. <br /> <br />Mayor Hardin inquired how that ail fits into Mr. Jankowski's time table. <br /> <br />Mr. Jankowski replied he would like to take action as soon as possible. He inquired if all <br />the Statute steps had to be done prior to expending any money. <br /> <br />Terry Hendriksen, 15631 Ramsey Boulevard N.W., Ramsey, stated that this is really the <br />project that was ordered in 1989, the feasibility study was done then and the project was <br />ordered by the Council. He continued that in 1989, when the City built a road, he was <br />concerned about the water and whether or not it had a place to go. He stated he had <br />provided written input and Council at that time felt the concern was important enough to <br />order the project. He added that he sees no legal reason why the funding cannot come from <br />assessments. <br /> <br />Mr. Goodrich reiterated that if it is to be assessed, it has to be done under Chapter 444 and <br />a public hearing has to be held. In 1989, it was handled under Chapter 429 as a single <br />street project; this is different. <br /> <br />Mr. Hendriksen stated that Council authorized funds be expended to do this project. At the <br />public hearing he asked that this project be done before the street was reconstructed. He <br />stated he was assessed, but it never happened. He inquired how long he should have to <br />endure this problem. He felt that all this had been done before and asked how many more <br />meetings and how many more public hearings there has to be. <br /> <br />Mr. Goodrich explained again that in 1989, the project was under Chapter 429 and had to <br />be completed within a year. To assess it, it has to be done under Chapter 444. <br /> <br />Mr. Hendriksen stated he did not believe that the drainage was supposed to be assessed to <br />benefitted property owners. <br /> <br />Mr. Goodrich asked Mr. Hendriksen if his position is that this project should be funded out <br />of the general fund. <br /> <br />Mr. Hendriksen stated he does not believe that funding should be the issue to not begin this <br />project. <br /> <br />Councilmember Beyer inquired how many property owners would be assessed. <br /> <br />Mr. Jankowski replied it would be about two-thirds of the City. <br /> <br />Councilmember Beyer questioned if Council didn't direct this project be done under <br />Chapter 444 last year. <br /> <br />Mr. Goodrich answered yes. <br /> <br /> Councilmember Beyer then inquired why nothing was started. <br /> <br /> Mr. Jankowski replied that Staff has been working on this issue. <br /> <br /> Councilmember Beyer stated she is getting irritated and she would like to see this project <br /> come to a satisfactory conclusion.
