Mr. Jankowskt replied it has not been designated flood plain. <br /> <br /> Mr. Berg state4t that someone built too low and the City is asking everyone in the district to <br /> bail him out. He suggested assessing all and refunding the residents who paid to have a <br /> storm sewer developed. <br /> <br /> Mr. Goodrich istated that there was an ordinance adopted in 1986 that excluded certain <br /> properties fro~ assessments for this type of project for five years (1991). <br /> <br /> Mr. Berg stated that the City cannot show benefit to his property in River's Bend. <br /> <br /> Mr. Goodrich explained that individual benefit does not have to be shown under Chapter <br /> 444. <br /> <br /> Charles Canesi, 7751 - 166th Avenue N.W., Ramsey, inquired how many homes are in <br /> the drainage ar~a. <br /> <br /> Mr. Jankowski replied about 4,000. <br /> <br /> Mr. Canesi inquired if the land that will be saved will eventually be developed. <br /> <br /> Mr. Jankowski ~replied that the area is currently rural but it possibly could be developed in <br /> the future. <br /> <br />Mr. Canesi suggested levying a tax on the developer and leaving the citizens alone. He <br />commented thatmaybe the residents should have a Boston Tea Party; enough is enough. <br />He inquired if ~ permit was given for the pond. <br /> <br />Mr. Jankowski Stated he did not believe a permit had been issued for the pond. <br /> <br />Mr. Canesi suggested taking the pond out. <br /> <br />Mr. Jankowskistated that this is a natural low area. The City has no reason to dictate what <br />the owner coulddo with his land. <br />Mr. Canesi inquired if it was built in the line of the ancient ditch. <br /> <br />Mr. Jankowski replied yes. <br /> <br />Mr. Canesi stated that the City is at fault. He stated that if the person put the pond in <br />without the Citg's knowledge, they should be fined. <br /> <br />Mr. Schroeder 8rated that there is a natural drainage way. The City of Ramsey does not <br />have a right to ~e on that property. We do not own an easement to ensure the drainage <br />goes anywhere. :part of this project is to gain a right to a utility and drainage easement. <br /> <br />Mr. Canesi inquired who built the drainage way. <br /> <br />Mr. Jankowski r,plied County Ditch #3 was constructed by the County in 1890 - they have <br />legal rights to th}tt land. We do not know who constructed the lateral ditch - presumably <br />the land owner. <br /> <br />Mr. Canesi inquired if there is a potential of homes being built there. <br /> <br /> City Council/March 14, 1995 <br /> Page 5 of 15 <br /> <br /> <br />
