<br />DECLARATION OF COVENANTS, CONDITIONS AND
<br />RESTRICTIONS FOR RAMSEY BUSINESS PARK 95

<br />This Declaration i~ made as of
<br />Minnesota Munidpal corporation (the "Declarant").
<br />
<br />,1995 by the City of Ramsey, a
<br />
<br /> WHEREAS, Declarant is the owner of real property in the City of Ramsey, Anoka
<br />County, MinnesoO, legally described on Exhibit A attached to this Declaration, and Declarant
<br />desires to submi~ said real property and all improvements on it (collectively called the
<br />"property") to the i0rovisions of this Declaration; and

<br /> WHEREAS, Declarant has established an area within the corporate limits of the City
<br />of Ramsey, known as the Ramsey Business Park 95, which area is identified on Exhibit B
<br />attached to this D~laration, and Declarant has the option of adding or allowing to be added to
<br />the provisions of ~his Declaration, all or part of the real property in the Ramsey Business Park
<br />95 ("Additional Property"); and
<br />
<br /> WHEREAS, Declarant desires to declare and establish covenants, conditions and
<br />restrictions whicla will benefit and burden the property for the purpose of facilitating
<br />development of ~e property and for the purpose of protecting and preserving the value and
<br />desirability of the }0roperty.

<br /> THEREFORE, Declarant declares that the property and any additional property added
<br />to the provisions ~f this Declaration shall be owned, used, occupied and conveyed subject to
<br />the covenants, coJaditions and restrictions set forth in this Declaration, all of which shall be
<br />binding on all Persons owning or acquiring any right, tire or interest in the property and their
<br />heirs, personal re@resentatives, successors and assigns.

<br />SECTION 1
<br />DEFINITIONS
<br />
<br /> 1.01 "Ad~litional Property" shah mean the real property in the Ramsey Business
<br />Park 95 area ide~ptified on Exhibit B (except the real property described on Exhibit A),
<br />including all imprOvements located on the real property now or in the future, and all easements
<br />and rights appui't~nant to it, which real property Declarant has the fight to add or allow to be
<br />added to the provisions of this Declaration.
<br />
<br /> 1.02 "Architectural Review Board" shall mean the board established pursuant to
<br />Section 3 of this Declaration.
<br />
<br />1.03 "De.clarant" shall mean the City of Ramsey
<br />
<br /> 1.04 "Improvements" shall mean all structures and other construction on a lot or
<br />parcel for a use p~rmitted by the zoning ordinances of the City of Ramsey, including, but not
<br />limited to, buildings, outbuildings, parking areas, loading areas, outside platforms and docks,
<br />driveways, walkways, fences, lawns, landscaping, signs, retaining walls, screening walls,
<br />decks, railroad traCks, poles, berms and swales, and exterior lighting.
<br />
<br /> 1.05 "LOP' shall mean a portion of the property identified as a lot on a subdivision
<br />plat prepared in a~cordance with Minnesota Statutes, Chapter 505, and filed for record in the
<br />office of the Anoka County Recorder or Anoka County Registrar of Titles.
