Mr. Jankowski stated that this is one of the issues discussed at the Road and Bridge <br />Committee meeting. The Johnston's have their driveway on the County Road but they <br />have frontage On one or more of the residential streets. Our policy has been to assess <br />comer lots a fall share when the appropriate frontage received the improvement. In this <br />case, they wot/Id never receive an assessment because they are on the County Road. The <br />Road and Bridge Committee recommended they should pay a share equal to everyone else <br />in the subdivision. <br /> <br />Councilmemb$:r Peterson inquired ff this would be dealt with on a case-by-case basis or if <br />we would be changing the policy. <br /> <br />Mr. Jankowsld stated that in thc case where property fronts on residential and MSA streets, <br />a full assessm&nt should be charged when the improvement gets made to the residential <br />street. This at~lress fronts on a County Road and a residential street. <br /> <br />A letter receiwed from the Johnston's stated they would be willing to pay 50% of the <br />assessment, however, they do object to a full assessment. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to amend the <br />assessment to ~;how that the Johnston's will be paying one-half the amount. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen <br />and Zimmerman. Voting No: None. <br /> <br />Motion by CoUncilmember Peterson and seconded by Councilmember Beyer to close the <br />public hearing, <br /> <br />Motion carded. Voting No: None. <br /> <br />The public hearing closed at 7:31 p.m. <br /> <br />Council Bushiness <br /> <br />Mayor Hardin Called the regular portion of the City Council meeting back to order at 7:31 <br />p.m. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution g95-09-228 adopting assessment for Improvement Project g95-09 (Bituminous <br />overlay SportslHaven and Carol Rose Acres Additions) <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer, Beahen <br />and Peterson. Voting No: None. <br /> <br />Mr. Jankowskt alerted Council that the same situation as the Johnston's occurs for two <br />more property ;owners in ~95-10 and also one in #95-05. <br /> <br />Discussion ensued and it was determined that the City should pick up the difference in the <br />assessments frOm assessing certain properties 50%. <br /> <br />Motion by Cpuncilmember Peterson and seconded by Councilmember Beyer that <br />Improvement ~oject 4/95-05 assessment be amended so that the similar property as the <br />Johnston's pays one-half the assessment. <br /> <br /> City Council/September 26, 1995 <br /> Page I1 of 22 <br /> <br /> <br />
