1) <br /> <br />Request fo/a Conditional Use Permit for a Foster Care Group Home; Case of Patrick <br />McLaffculy ~ <br /> <br />Chairperson Bawde~n called the regular Planning Commission meeting back to order at 8:06 p.m. <br />COMMISSION iBUSINESS <br /> <br />Case #1: Req~ttest for Sketch Plan Review of Fox Knoll; Case of Rick Murray, <br /> Res!dential I)evelopment Company, and Mark Kleckner, Fox <br /> I)evifiopment Co. <br /> <br />City Engineer Jan~owski advised that Rick Murray of Residential Development Company and <br />Mark Kleclmer of l~ox Development Company are requesting approval of a revised sketch plan for <br />Fox Knoll. Mr. ~I.ar~kowsld explained that Mr. Kleekner had applied for a subdivision last year to <br />plat the 20 acres info two 10-acre rural lots, however, City Stiff convinced him to postpone his <br />plat until this yea due to the anticipated expansion of the Metropolitan Urban Service Area <br />(MUSA) and the a~.ailability of sewer and water to the site by mid 1995, which would allow the <br />property to be developed at urban densities. The subject property is now in the MUSA and is <br />zoned R-1 Urban Residential. Mr./ankowski stated there will be approximately 18-20 single <br />family units. He ndted that 151st Lane N.W. will be extended, resulting in exceeding the 600 foot <br />maximum dead end[street length, and that another cul-de-sac will be extended off 151 st to access <br />the remainder of thi developable property. He explained that the over-extended length of 151 st is <br />the only reasonabl~ means of developing this property short of bridging wetlands (which is <br />unacceptable to DI'iR) to construct through streets. Mr. Jankowski advised it is anticipated that <br />sewer and water wi be provided to the property by extending the sewer trunk along the wetland <br />somewhat in conju :tion with the service to the school, and the water will be extending also in <br />conjunction with tk extension to the school without going through the Haubrich Addition. The <br />anticipated drainage will be predominantly from east to west, and will require some type of <br />ponding, possibly :n the park area, prior to discharge in the wetland. There are also plans to <br />extend the trail thro~ gh the subdivision over to the school property. <br /> <br />Rick Murray, Resid :ntial Development Company, stated that this is a beautiful site, adding that he <br />had initial concerns!on incorporating a road system with the least amount of impact on the wetland <br />and trees. He pret~ented Concept Plan #1, outlining the wetland, trees, proposed roads, and <br />building sites. ~ <br /> <br />Commissioner Deemer inquired as to the status of the tree ordinance. <br /> <br />Mr. Jankowski stated that the ordinance is still in the drafting stage and cannot be enforced, <br />however the City has been getting cooperation from the developers. <br /> <br />Commissioner Deemer informed the applicant that this was not an official tool for the City. <br /> <br />Mr. Murray stated l~e has been made aware of that, however, he will do what he can to cooperate <br />since he stands to benefit as well. Mr. Murray noted that he did have concerns with the trail <br />extension due to th~fact that he does not own all the property involved. <br /> <br />Motion by Commi~;sioner Deemer and seconded by Commissioner Holland to grant sketch plan <br />approval to Fox Krloll and recommend that the developer proceed to apply for preliminary plat <br />approval. <br /> <br />Motion carried. ~oting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, LaDuei and Terry.
