Mr. Jankows~ replied it has not been designated flood plain. <br /> <br />Mr. Berg stated~ that someone built too Iow and the City is asking everyone in the district to <br />bail him out. ~e suggested assessing all and refunding the residents who paid to have a <br />storm sewer d~veloped. <br /> <br />Mr. Goodrichl-stated that there was an ordinance adopted in 1986 that excluded certain <br />properties froth assessments for-this type of project for five years (1991). <br /> <br />Mr. Berg stated that the City cannot show benefit to his property in River's Bend. <br /> <br />Mr. Goodrich iexplained that individual benefit does not have to be shown under Chapter <br />444. <br /> <br />Charles Caneai, 7751 - 166th Avenue N.W., Ramsey, inquired how many homes are in <br />the drainage re'ea. <br /> <br />Mr. Jankowsk! replied about 4,000. <br /> <br />Mr. Canesi inquired if the land that will be saved will eventually be developed. <br /> <br />Mr. Jankowski replied that the area is currently rural but it possibly could be developed in <br />the future. <br /> <br />Mr. Canesi suggested levying a tax on the developer and leaving the citizens alone. He <br />commented tt~at maybe the residents should have a Boston Tea Party; enough is enough. <br />He inquired if;~ permit was given for the pond. <br /> <br />Mr. Jankowski stated he did not believe a permit had been issued for the pond. <br /> <br />Mr. Canesi suggested taking the pond out. <br /> <br />Mr. Jankowsk4 stated that this is a natural Iow area. The City has no reason to dictate what <br />the owner could do with his land. <br /> <br />Mr. Canesi inquired if it was built in the line of the ancient ditch. <br /> <br />Mr. Jankowski replied yes. <br /> <br />Mr. Canesi stated that the City is at fault. He stated that if the person put the pond in <br />without the Ciiy's knowledge, they should be fined. <br /> <br />Mr. Schroede~ stated that there is a natural drainage way. The City of Ramsey does not <br />have a fight t~ be on that property. We do not own an easement to ensure the drainage <br />goes anywherO,'.. Part of this project is to gain a fight to a utility and drainage easement. <br /> <br />Mr. Canesi inquired who built the drainage way. <br /> <br />Mr. Jankowsk~ replied County Ditch #3 was constructed by the County in 1890 - they have <br />legal rights to ithat land. We do not know who constructed the lateral ditch - presumably <br />the land owner. <br /> <br />Mr. Canesi inquired if there is a potential of homes being built there. <br /> <br />City Council/March 14, 1995 <br /> Page 5 of 15 <br /> <br /> <br />
