Attorney Goodrich reiterated that Council would have to introduce this in the form of an <br />ordinance. <br /> <br />Lori Farber, 171st Lane in Ramsey, stated she is present to represent the people on 171st <br />Lane. She is the representative because her property has the worst of the water run-off <br />problem. She stated that the C~ty had given the Srmth s a variance to build then' home on a <br />hill and now th.ere is a storm water run-offproblem. She asked who's responsibility it is to <br />take care of thi~ problem - the City's or the Smith's. She stated that the water is backing up <br />into the sewer i: system and into her basement. The water that's flowing into their drain <br />fields is sewage. <br /> <br />City Administrgtor Schroeder stated that he and Mr. Jankowski have been trying to get out <br />to view the pro~>lem since the middle of last week. The issue is "does someone ,,need to dig <br />a 300 to 500 t[oot ditch or should Mr. Smith be directed to do something '. He had <br />suggested to Ms. Farber that there are a number of drainage issues in the City. Staff is <br />planning to co~e to City Council with all these concerns and to get the list prioritized. He <br />offered to check Ms. Farber's property and report his findings back to Council. <br /> <br />Ms. Farber agatn asked who's responsibility it would be or is it on a case by case basis. <br /> <br />Attorney Goodrich stated that it could be the owners, or it could be the responsibility of <br />whomever is ~eating the problem. The City will deal with their responsibility, but this <br />may not be the ~2ity' responsibility either. <br /> <br />Ms. Farber askad if the City could make Mr. Smith do something about it. <br /> <br />Attorney Goodd~'ch replied no, the property owners would have to take care of dealing with <br />that. <br /> <br />Mr. Schroeder assured Ms. Farber that Staff would be out to her property this week and <br />would come badk to Council with some type of a recommendation. <br /> <br />Councilmember Zimmerman stated he could name a half dozen new subdivisions with <br />water problems.. He felt that there should be something the City can do to hold the <br />developers som{what responsible for problems such as this. <br /> <br />Consensus was t~hat the Road and Bridge Committee could discuss a vehicle for the City to <br />hold the developers somewhat responsible in issues such as this one. <br /> <br />Beth Mitchell, 8~500 - 176th Lane N.W., Ramsey, announced the date of the Environmental <br />Expo~ .?he state~l that from what she hears, the City Council has decided how to vote on <br />the City s zoning with regard to Case #6. <br /> <br />Ms. Mitchell was informed that she could speak to Case #6 at the time it is brought up for <br />discussion. <br /> <br />APPROVE AGENDA <br /> <br />Motion by Coun¢ilmember Peterson and seconded by Councilmember Beyer to approve the <br />agenda as presented but to not begin discussion of any new cases after 10:00 p.m. <br /> <br />Motion carded. !Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen <br />and Zimmerman, Voting No: None. <br /> <br />City <br /> <br />Council/April 25, 1995 <br /> Page 3 of 23 <br /> <br /> <br />
