~ ~ it- <br /> <br />Councilmeml~er <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION ~95-01- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br /> PROPERTY FROM R-1 RURAL RESIDENTIAL--~qD B-2 BUSINESS TO <br /> R-3 URBAN RESIDENTIAL <br /> <br /> WHE~REAS, the City received an application for sire'plan approval to expand R~amsey <br />Elementary S~hool and it has been determined that a rezoning of the subject property to R- ~ Urban <br />Residential is hecessary to accommodate the expansion. <br /> <br />NOW TttE~EFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSE)', ANOKA COUNTY, STATE OF MINNESOTA, as foBows: <br /> <br />That &noka Hcnnepin Independent School District No. 11 is proposing to expand Ramscy <br />Elementary School and has acquired two parcels south of thc existing school site to <br />accon~odate the expansion. <br /> <br />That the existing school site is zoned R-1 Rural Residential and the acquired parcels to the <br />south ye zoned B-~ Business, for which schools are not a permitted use. To expand the <br />lawfulhon-conforming structure would require a conditional use permit or a rezoning of <br />the property to R-3 Urban Residential, for whichs schools are ~ permitted use. <br /> <br />That A,noka Henncpin Independent School District No. l 1, hereinafter referred to as <br />"Applioant", has requested the rezoning of certain property from R- 1 Rural Residential and <br />B-2 BuSiness to R-3 Urban Residential. <br /> <br />That the Planning Commi.,ssion conducted a public hearing pursuant to Section 9.03.03 of <br />the Ci~ Code on January z, 1995 and that said pubE. e-hearing was properly advertised and <br />that the minutes of said public hearing are hereby incorporated by reference. <br /> <br />5. That th= property proposed to be rezoned is legally described as follows: <br /> <br />All that part of the South Half of the Southeast Qum"ter of Section 23, Township 32, <br />25, Anoka County Mfinnesom, lying west of the public road 'known as Nowthen Boulev~d <br />N.W., excepting therefrom a triangle containing 1/2 square rod described as follows to-wit: <br />Commevcing at the Southwest comer of said South Haft of the Southeast Quarter of <br />Section 23; thence North along the West line thereof a distance of 16-1/2 feet; thence in <br />Southeasterly direction to a point on the South line of said South Half of the Southeast <br />Quarter ~,'hich is distant 16-1/2 feet East of the Southwest comer thereof; thence West on <br />said Somth line a distance of 16-1/2 feet to the point of beginning.
