CASE # 3 <br /> <br />REQUEST FOR SITE PLAN APPROVAL; CASE OF RALPH'S GUN AND PAWN <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In Septembar~ of 1993, Ralph Nissan relocated P~atph's Gun & Pawn from 6131 Highway #10 N.W. <br />to 6101 Higt~way #10 N.W. The addr¢ss of 6101 Highway #10 N.W. was deficient of certain site <br />improvementt such as paved and curbed clrive and customer/employee partdng ames. hit. Nissan was <br />informed by ,~iry Stuff that these site improvements ware r~quired in order :[or commercial activiD, to <br />occur on the ~rop~-r~y. Approval for these site improvements must be obtained from the City via a site <br />plan approval! <br /> <br />On September 30, 1993, Mr. Nissen indicated to Staff that because of obligations to consignment <br />clients of the. ipawn shop and for financial reasons, it was imperative that the pawn shop open for <br />business at toe new location prior to obtaining site plan approval and installing the required site <br />improvementi. Staff agreed that the pawn shop could opan for business and that blacktopping <br />improvements~ could be installed prior to site plan approval to avoid a muddy parkfing lot during the fall <br />and winter. This prior approval was confing:m upon Mr. Nissen submimng a site plan application that <br />would includeithe installation of cement curbing and an), necessary, corr~tions to the blacktop installed <br />based on drair~ag¢ patterns. To insure that the site plan approval was properly applied for and that the <br />improvements would be installed to City standards, Mr. Nissen would deposit a financial guarantee <br />with the City {n the amount of $4,500, which is an amount equal to !50% of the estimated cost of the <br />required site ir~provements. <br /> <br />On or abou; Qctober 1, !993, the blacktop was insm.lled at 6101 Highway #10 N.W. and Mr. Nissan <br />had not deposi!ed the requirccl financial guarantee with the CID'. <br /> <br /> O" <br />On Dec:tuber .14, 1.9~, Air. Nissen met with Staff and indicated that because of impro~,,ements made <br />to the bnildingtand site at 6101 I-Sghway #10 N.W., his ,f~jl,.,ancial resources were exhausted and he did <br />not have the $4,500 financial. ¢uarantee. At that time, th..re~.was verbal agreament between Mc.
