~HE ZONING REPORT <br /> <br />Page Eight <br /> <br />levelopment features or ~u~n_ique operating char- <br />~cteristics requiring special consideration so <br />~hat they ma.y be located, designed, and oper- <br />ated compatibly with uses on surrounding prop- <br />~rties and within the City at large. The condi- <br />tional use process is intended to encourage <br />~road public review and evaluation of site de- <br />velopment features and operating characteris- <br />tics, and to ensure adequate mitigation of po- <br />tentially unfavorable impacts." <br />[Austin TX development code] : <br /> <br />"Description and Purpose. It is recognized that <br />certain types of uses require special considera- <br />tion prior to their being permitted in a partic- <br />ular district. The reasons for requiring such <br />special consideration involve, among other <br />things, the size of the area required for the <br />full development of such uses, the nature of <br />the traffic problems incidental to operation of <br />the use, the effect such uses have on any ad- <br />joining land uses and on the growth and devel- <br />opment of the community as a whole. <br /> "Ali Uses permitted conditionally are declar- <br />ed to be possessing such unique and special <br />characteristics as to make impractical their <br />being included as outright uses in any of the <br />various districts herein defined. The authority <br />for the location and o'peration thereof shall be <br />subject to review and the issuance of a Condi- <br />tional Use Permit. The purpose of review shall <br />be to determine that .the characteristics of any <br />such use shall be reasonably compatible with <br />the type of uses permitted in surrounding <br />areas, and for the further purpose of stipulat- <br />ing such conditions as may be reasonable so <br />that the basic purposes of the ordinance shall <br />be served. Nothing construed herein shall be <br />deemed to require the hearings official or com- <br />mission to grant a Conditional Use Permit. <br /> <br /> "The hearing official shall designate condi- <br />tions in connection with the Conditional Use <br />Per~n~it as he deems necessary to secure the <br />purpose of [the conditional use permit chapter <br />of the Zoning code], and require the guarantees <br />and evidence that such conditions will be com- <br />plied with. Such conditions may include: <br /> <br />"(a) Regulation of uses. <br />'~(b) Special yards, spaces. <br />"(c) Fences and walls. <br />"(d) Surfacing of parking areas to city specifi- <br />cations. <br />"(e) Street dedications and improvements (or <br />bonds). <br />"(f) Regulation of points of vehicular ingress <br />and egress. <br />"(g) Regulation of signs. ' <br />"(h) Landscaping and maintenance thereof. <br />"(i) Maintenance of the grounds. <br />"(j) Regulation of noise, vibration, offensive <br />odors, hazardous biological materials~ and other <br />nuisances to a greater extent than set forth in <br />[this code] . . . <br />"(k) Regulation.of time for certain activities. <br />"(1) Time period within which the proposed use <br />shall be developed. <br />"{m) Duration of use. <br />"(n) Such other conditions as will make possible <br />the development of the city in an orderly and <br />efficient manner . . ."
