Section 9.21.07, Subd. lb, Maximum Impervious Surface. With regard to impervious surface, <br />refer to comments in Section 9.21.07, Sub& la above. Again, we are proposing to increase the <br />maximum building height restriction to 37 feet to allow for the construction of homes in the current <br />design trends. <br /> <br />Section 9.23.05, Subd. 2, items 1 and 2. It is Staffs opinion that campgrounds, governmental or <br />private, should require a conditional use permit. Staff is proposing to eliminate item 1 and add <br />governmental campgrounds to private campgrounds that require a conditional use permit in item 2. <br /> <br />Section 9.23.05, Subd, 2, item 8, Agricultural Uses. Staff feels that some of the agricultural uses <br />such as herbicides, pesticides and feed tots can be detrimental to the river, and therefore, Staff <br />proposes to change this item to require a conditional use permit for these types of uses. <br /> <br />Section 9.23.05, Subd. 2, item 11, Essential Services. Staff feels that the definition of essential <br />services falls more in line with item 18 in the same table regarding utility transmission power lines <br />and pipelines. Staff has proposed to eliminate item 11, Essential Services, and include it in item <br />18, Utility Transmission Power Lines, so that these essential services also require a conditional use <br />permit. <br /> <br />Section 9.23.06, Subd. 1, item 7. Again for reasons stated earlier, Staff is proposing to increase <br />the height restriction 37 feet and is proposing to eliminate that language that would exempt <br />agricultural buildings from this restriction. <br /> <br />Section 9.23.06, Subd. 2, item 1. Staff is proposing to increase the minimum lot size for riparian <br />and non-riparian lots from 4 and 2 I/2 acres to 10 acres. <br /> <br />Section 9.23.06, Subd. 2, item 7. Again, as explained above, Staff is proposing to increase the <br />maximum height restriction to 37 feet and to eliminate that language that exempts agricultural uses <br />from this restriction. <br /> <br />These proposed changes have been forwarded to DNR for review and comment. At this writing, <br />the City had received no response as to whether or not Staffs recommended changes will be <br />acceptable.
