Section 9.21.07, Subd. lb, Maximum Impervious Surface. With regard to impervious surface,
refer to comments in Section 9.21.07, Sub& la above. Again, we are proposing to increase the
maximum building height restriction to 37 feet to allow for the construction of homes in the current
design trends.

Section 9.23.05, Subd. 2, items 1 and 2. It is Staffs opinion that campgrounds, governmental or
private, should require a conditional use permit. Staff is proposing to eliminate item 1 and add
governmental campgrounds to private campgrounds that require a conditional use permit in item 2.

Section 9.23.05, Subd, 2, item 8, Agricultural Uses. Staff feels that some of the agricultural uses
such as herbicides, pesticides and feed tots can be detrimental to the river, and therefore, Staff
proposes to change this item to require a conditional use permit for these types of uses.

Section 9.23.05, Subd. 2, item 11, Essential Services. Staff feels that the definition of essential
services falls more in line with item 18 in the same table regarding utility transmission power lines
and pipelines. Staff has proposed to eliminate item 11, Essential Services, and include it in item
18, Utility Transmission Power Lines, so that these essential services also require a conditional use
permit.

Section 9.23.06, Subd. 1, item 7. Again for reasons stated earlier, Staff is proposing to increase
the height restriction 37 feet and is proposing to eliminate that language that would exempt
agricultural buildings from this restriction.

Section 9.23.06, Subd. 2, item 1. Staff is proposing to increase the minimum lot size for riparian
and non-riparian lots from 4 and 2 I/2 acres to 10 acres.

Section 9.23.06, Subd. 2, item 7. Again, as explained above, Staff is proposing to increase the
maximum height restriction to 37 feet and to eliminate that language that exempts agricultural uses
from this restriction.

These proposed changes have been forwarded to DNR for review and comment. At this writing,
the City had received no response as to whether or not Staffs recommended changes will be
acceptable. The proposed amendments to the shoreland and scenic rules will be a part of the
Comprehensive Plan amendment public hearing to be held on March 21.

Recommendation:

City Staff recommends that the Planning Commission review the proposed ordinance amendments
and direct Staff to incorporate any additional changes for DNR review and prior to the public
hearing.

Commission Action:

Motion to:
Direct City Staff to make any amendments deemed necessary by the Planning Commission,
solicit DNR review and proceed with the public hearing on March 21, 1995.

Review Checklist:

City Administrator
City Engineer
Building Official
Economic Development Coordinator
Parks & Utilities Supervisor

FC:

3/7/95

28'
