Execute development permit. <br /> <br />On the next regular Horse Care Board agenda, include a case by <br />Harvey Wibeto regarding proposed minimum standards for horse <br />shelters and fencing. <br /> <br />Council granted final plat approval to Rivenwick 2nd Addition. <br />Execute development agreement. <br /> <br />Council asked that the City Attorney and Staff review ordinance to <br />make sure City Code is as complete in its language as the State <br />Statutes with regard to Metes and Bounds subdivisions. <br /> <br />Findings of Fact - Rebecca Jackson's request for a CUP to maintain <br />an accessory apartment: The Planning Commission approved 1-7, <br />and directed Staff to amend the following: (8) "That the proposed <br />use will not adversely impact traffic in the area. (9) "That the <br />proposed use will not be dangerous or detrimental to persons <br />residing or working in the vicinity." (10) "That the proposed use <br />will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties." (1 I) "That the proposed <br />use will be maintained in order to be harmonious in appearance <br />with the existing and intended character of the R-1 Rural Residential <br />District." (12) "That the proposed use will be adequately served <br />by essential public services." (13) "That the proposed use will <br />not create excessive additional requirements at public cost for <br />public facilities and services." Add a finding to read "That at least <br />one neighbor opposes the granting of this permit." Add a f'mding to <br />read "That based on the comments at the public hearing and the <br />discussion of the Planning Commission on July 5, the consensus of <br />the Planning Commission was that the type of permit issued, if it is <br />issued, should be interim use rather than conditional use so that the <br />permit may expire concurrent with the applicant's ownership of the <br />property." The Planning Commission voted to recommend that <br />City Council adopt the amended findings of fact relating to Rebecca <br />Jackson's request for a conditional use permit for an accessory <br />apartment. Forward to City Council. Council tabled until <br />there is an ordinance in place, Applicant withdrew <br />request for apartment permit. <br /> <br /> <br />
