Case #2 <br /> <br />REQt~EST FOR A CONDITIONAL USE PERMIT TO STORE <br />COMMERCIAL EQUIPMENT IN THE R-1 RURAL <br />RESIDENTIAL DISTRICT; CASE OF DON GODDEN <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Section 9.11.10 (off-street parking) of the Ramsey City Code states that no more than one one-ton <br />motor vehicle bea/~)'ng a commercial license shall be parked or stored in a residential district. <br />Pursuant to a neighborhood sweep for Code enforcement purposes, Don Godden has applied for a <br />conditional use per, mit to store and maintain his semi-tractor and trailer on his property at 9027 <br />176th Avenue N.W;, The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) PropoSed findings of fact <br />d) PropoSed conditional use permit <br /> <br />Notification: <br /> <br />A conditional use l~ermit is required to be subjected to a public hearing. All persons owning <br />property within 350~ feet of the subject property are required to be notified of that public hearing. <br />In this particular c~se, City Staf~ notified all property owners within 1000 feet in order that all <br />persons living alon~ Mr. Godden s route from County Road #83 to his home would be cognizant <br />of the request and have opportunity for input. <br /> <br />Observations: <br /> <br />Mr. Godden's property is approximately one acre in size and there is a separate drive used for <br />parking the semi-tractor/trailer that is less obtrusive than the drive located in front of the home. <br />Mr. Godden does r~ot have an accessory structure that would accommodate storing the wack <br />indoors. Mr. Goddeh has stated that all major maintenance to the truck is done off site. <br />In 1989 and 1991, t~e Ramsey City Council approved the issuance of conditional use permits to <br />applicants in the R-I~ Rural Residential District to store as many as four single-axle trucks on their <br />properties. In 1994i the City Council denied an application to store commercial equipment on a <br />property based on thee amount of equipment to which the request applied to, and gave the applicant <br />a one-year grace period to find other accommodations for the storage of the equipment. <br /> <br />Recommendation~ <br /> <br />Based on the City Cpuncil's action in 1994, City Staffis interpreting a desire to cease storage of <br />commercial equipment in residential neighborhoods and recommending denial of this application <br />with a grace period to make arrangements for other accommodations. If it is the Planning <br />Commission's desire~ to recommend Council approval of the request, then a proposed conditional <br />use permit has been &ailed for consideration. <br /> <br />Commission ActiOn: <br /> <br />Motion to recommend that City Council adopt Resolution g95-06~ adopting Findings of Fact ~._ <br />relating to Mr. Godd~:n's request for a conditional use permit to store commercial equipment in a <br />residential district. <br /> <br /> <br />
