CASE <br /> <br />REQUEST FQR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT <br /> ~ SOILS; CASE OF NORTH FORK, INC. <br /> By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background: <br />On May 16, 1995, l~e City received an application from North Fork, Inc. to grade and export soils <br />from Lots 3 and 4, l~lock 2, Northfork Lake Addition. The purpose of the project is to create more <br />attractive building sates. . <br /> <br />The following items are enclosed for your information: <br /> <br /> a) Site iocafion map <br /> b) Applicant's letter and attached Grading Plan <br /> c) Pro!~sed f'mdings of fact <br /> d) Prop~' sed conditional use permit <br /> <br />Notification: <br /> <br />Conditional Use Permits are required to be subjected to public hearings with all properties within <br />350 feet being noticed of the public hearing. In this case, Staff attempted to notify all property <br />owners within 600 feet of the subject property. <br /> <br />Observations: <br /> <br />The applicant is prc~osing to strip the topsoil over an approximate two acre area and remove and <br />export approximately 16,000 cubic yards of materials to create walkout building pads closer to the <br />front of the two aft~ected lots. The material would be removed from the site by hauling belly <br />dumps down Invenie, ss westward for a distance of approximately 800 feet, and from there would <br />be hauled across oi~tlot and golf course property to the northern boundary of the Burlington <br />Northern right of w~y, and then onto 153rd southward to U.S. gl0. The applicant would also be <br />allowed to utilize th~ mater/al in the grading of the outlot in accordance with the approved grading <br />plan. This haul rout~ would minimize the impact to the residents of Nonhfork. <br />Staff would recomn~end that the grading and hauling operation be confined to a two week period <br />from start to finish ahd that turf restoration be initiated immediately upon the finish of grading and <br />be completed within!one additional week. <br /> <br />Silt fence and other'~erosion control measures should be required to protect adjacent properties. <br />The revised grading Would not affect existing drainage patterns. <br /> <br />Recommendation: <br /> <br />City Staff recomme.r~cls approval of the permit. <br /> Commission Action: <br /> <br /> Motion to: <br /> Recommend ~at City Council adopt Findings of Fact # <br /> for a conditional use permit to grade and export softs. <br /> <br />relating to North Fork's request <br /> <br />-and- <br /> <br /> <br />
