Case #1 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO STORE <br />COMME[RCIAL LANDSCAPING EQUIPMENT IN THE R-1 RURAL <br />RESIDENTIAL DISTRICT; CASE OF MIKE BAHN <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Section 9.11.10 (off-street parking) of the Ramsey City Code states that no more than one one-ton <br />motor vehicle bea~ing a commercial license shall be parked or stored in a residential district. <br />Pursuant to a neigl~borhood sweep for Code enforCement purposes, Mike Bahn has applied for a <br />conditional use pe ~/~rnit to store and maintain commercial landscaping equipment on his property at <br />14911 Juniper Ridge Drive N.W. The following items are enclosed for your information: <br /> <br /> a) Site l~ation map <br /> b) Site plan <br /> c) PropOSed findings of fact <br /> d) PropOsed conditional use permit <br /> <br />Noti fi ca ti on: <br /> <br />City Code requires, that conditional use permits be subjected to a public hearing and all parcels <br />within 350 feet of .l~e subject property should be notified of that public hearing. In this particular <br />case, City Staff notified all property owners along Mr. Bahn's traveled routes in and out of the <br />neighborhood so they would be cognizant of the request and have opportunity for input. Mr. Bahn <br />indicated that his v~-hicles sometimes travel north on Juniper Ridge Drive to 153rd Avenue, or east <br />on 150th, then south on Waco Street, and east on 149th Avenue. <br /> <br />Observations: <br /> <br />Michael Bahn is prOposing to store two 2-1/2 ton single-axle dump trucks, one bobcat, and one <br />14-foot bobcat trailbr on his property. It is obvious from the amount of equipment proposed to be <br />stored that he is not a single operator of this business and he does have employees coming to the <br />home to pick up wckk orders and equipment. <br /> <br />Recommendation: <br /> <br />The City has previously issued conditional use permits to store commercial equipment in a <br />residential neighb~hood, however, in 1994, the City Council denied an application to store <br />substantial numbersiof commercial equipment on one residential property. In view of the fact that <br />Mr. Bahn is not a s01e employee and has other employees coming to the home, it is City Staff's <br />recommendation th~tt the request for a conditional use permit be denied and Mr. Bahn be given a <br />one-year grace peri~ to m, ake other accommodations for storing his commercial equipment. If it is <br />the Planning Commission s desire to recommend Council approval of the request, then a proposed <br />conditional use pen~,.'t has been drafted for consideration. <br /> <br />Commission ActiOn: <br /> <br />Motion to recommend that City Council adopt Resolution g05-0~..._ adopting Findings of Fact # <br />relating to Mr. Balm's request for a conditional use permit to store commercial landscaping <br />equipment in a residdntial district. <br /> <br />-and- <br /> <br /> <br />
