Councilmember i introduced the following resolution and moved for its adoption: RESOLUTION NO. 95-06- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BAS~aON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO GI~ADE AND EXPORT SOILS WHEREA~, the Ramsey City Council adopted Resolution No. 95-06- adopting Findings of Fact #~_~_ for this use and herein approves the Conditional Use Permit subject to the following condition's. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ~A~OKA COUNTY, STATE OF MINNESOTA, as follows: On , 19~5, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to North Fork, Inc. ("Permit Holder") for grading operations on the property legally described as follow~: Lots 3 and ~, Block 2, NORTH FORK LAKE ADDITION, Anoka County, Minnesota. This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this .p6n'nit are as follows: 1. This permit i;hall expire on ,1995. o All equipmept used for grading and hauling operations shall be maintained and operated in such a mant~er to minimize noise, dust, and vibrations adversely affecting surrounding properties. Ail equipment shall be kept in good repair. Failed equipment and rubbish shall be removed ~om the worksite regularly. All worksite~ shall be properly safeguarded to prevent the general public from depositing garbage or o~her refuse on the worksite. 4. Existing treeand groundcover shall be preserved to the extent feasible. Grading ope.rations shall be conducted in such a manner to minimize interference with the surface wate/~ drainage outside the boundaries of the operation. o No grading qperations shall occur at below an elevation of 6 feet above the elevation of the water table on the worksite. Fencing maR be ordered by the City Council or City Engineer anytime the permit is in force and shall be ~stalled within 24 hours of written notice. . All access roads to and from the Subject Property, shall be maintained in order to minimize dust. The maximuga~.~ slope other than the working face shall be sloped on all sides no steeper than a rate of 2 fo~t horizontal to 1 foot vertical. In no case shall the slope of the working face be left unattended with a slope greater than 2 feet horizontal to i foot vertical. When mining oper~ttions are anticipated to be discontinued for an interval greater than one working day}the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical.
