Councilmember i introduced the following resolution and moved for its adoption: <br /> RESOLUTION NO. 95-06- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT BAS~aON FINDINGS OF FACT # AND DECLARING TERMS OF <br />PERMIT TO GI~ADE AND EXPORT SOILS <br /> WHEREA~, the Ramsey City Council adopted Resolution No. 95-06- adopting <br />Findings of Fact #~_~_ for this use and herein approves the Conditional Use Permit subject to the <br />following condition's. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ~A~OKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On , 19~5, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to North Fork, Inc. ("Permit Holder") for grading operations on the property legally <br />described as follow~: <br /> Lots 3 and ~, Block 2, NORTH FORK LAKE ADDITION, Anoka County, Minnesota. <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this .p6n'nit are as follows: <br /> <br />1. This permit i;hall expire on ,1995. <br /> <br />o <br /> <br />All equipmept used for grading and hauling operations shall be maintained and operated in <br />such a mant~er to minimize noise, dust, and vibrations adversely affecting surrounding <br />properties. Ail equipment shall be kept in good repair. Failed equipment and rubbish shall <br />be removed ~om the worksite regularly. <br /> <br />All worksite~ shall be properly safeguarded to prevent the general public from depositing <br />garbage or o~her refuse on the worksite. <br /> <br />4. Existing treeand groundcover shall be preserved to the extent feasible. <br /> <br />Grading ope.rations shall be conducted in such a manner to minimize interference with the <br />surface wate/~ drainage outside the boundaries of the operation. <br /> <br />o <br /> <br />No grading qperations shall occur at below an elevation of 6 feet above the elevation of the <br />water table on the worksite. <br /> <br />Fencing maR be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be ~stalled within 24 hours of written notice. . <br /> <br />All access roads to and from the Subject Property, shall be maintained in order to minimize <br />dust. <br /> <br />The maximuga~.~ slope other than the working face shall be sloped on all sides no steeper than <br />a rate of 2 fo~t horizontal to 1 foot vertical. In no case shall the slope of the working face <br />be left unattended with a slope greater than 2 feet horizontal to i foot vertical. When <br />mining oper~ttions are anticipated to be discontinued for an interval greater than one <br />working day}the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 <br />foot vertical. <br /> <br /> <br />
