18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />All costs iqcurred by the City in executing and administering this permit shall be the <br />responsibility of the permit holder. The permit holder shall maintain a minimum Five <br />Hundred D~llar ($500.00) balance in an escrow account with the City. This escrow shall <br />be used to r~imburse the City for expenses incurred in the administration of this permit. At <br />the time th~ mining operation and site restoration are completed to the satisfaction of the <br />City, the balance of the escrow shall be returned to the Permit Holder. <br /> <br />The haul ro ~te for the excavated material shall be from the site westward for a distance of <br />approximat fly 800 feet, and from there across outlot and golf course to the northern <br />boundary ol the Burlington Northern right of way and then onto 153rd Avenue N.W., and <br />then south'~ ard to U.S. #10. It may also be permissible to place the material on the ouflot <br />in accordan, e with an approved grading plan. <br /> <br />All grading pperations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only <br />unless otherwise specifically approved by the City Administrator and/or his designee. <br /> <br />The amoun~ of dust or other particulate matter caused by the mining operation shall not <br />exceed the s~mdards established by the Minnesota Pollution Control Agency. No operation <br />shall be allo~ed when wind gust exceed 30 miles per hour. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulations ,~.d Federal and Environmental Promcfion Agency regulations for the protection <br />of water quflity. <br /> <br />All haul ro~s are subject to the approval of the City Engineer. While hauling operations <br />are in progr{~ss, the permit holder shall maintain the haul road in a condition satisfactory to <br />the City Engineer. When hauling operations are completed, the permit holder shall either <br />restore that aaul road to a condition at least equal to that which existed at the time the <br />hauling ope :ations were started, or compensate the local road authority in an amount <br />satisfactory o that road authority and concurred in by the City Engineer for the restoration <br />of that haul i:oad. The City Engineer will then accept such restoration or concur in such <br />financial set lement for the restoration of the haul road in writing and such acceptance will <br />relieve the I~rmit holder of any additional obligation in connection with the restoration of <br />the haul roa~ Is. If the permit holder fails or refuses to perform haul road restoration or to <br />make satisf tctory financial settlement for such restoration, the City will cause the <br />restoration ~ork to be done and require reimbursement from the financial guarantee <br />required herein. <br /> <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br /> ~and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following v~ted against the same <br />and the following abstained <br />and the following were absent <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />the__, day of ~ ,1995. <br /> <br /> <br />
