CASE #t~ <br /> <br /> REQUES~ FOR A CONDITIONAL USE PERMIT GRADING SOILS; <br /> CASE OF NORTH FORK, INC. <br />By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On May 16, 1995, ~e City received an application from North Fork, Inc. to grade soils on Lots 5, <br />6, 7 and 8, Block 2~ Northfork Links Addition. The purpose of the project is to create walkout <br />building sites. The ~following items are enclosed for your information: <br /> <br /> a) Site location map <br /> b) Applicant's letter and attached Grading Plan <br /> c) ProlgpSed f'mdings of fact <br /> d) Propbsed conditional use permit <br /> <br />Noti fica ti on: <br /> <br />Conditional Use Pe~.its are required to be subjected to public hearings with all properties within <br />350 feet being notiqied of the public hearing. In this case, Staff attempted to notify all property <br />owners within 500 ~eet of the subject property. . <br /> <br />Observations: <br /> <br />The applicant is pro~- osing regrading four lots to raise the building pad elevations four to seven feet <br />to accommodate wNkout type homes. The change in grade will result in the steepening of <br />driveways to these l~omes. A maximum grade of 8% on driveways is recommended. Straight line <br />grade between the bgilding pad and the street would range between 6% and 7%, however, creating <br />a flat landing area in'front of the garage could increase these grades over the 8% target. <br /> <br />A second concern relates to drainage, particularly the flooding potential of the created walkout lots. <br />The areas west of th{ subject properties appears to be a low area without an outlet. The golf course <br />property to the weslt rises. Although a swale is proposed between Lots 7 and 8, the elevation of <br />Andrie is only 0.1 b[low the proposed walkout elevation of 881.0. Water would need to travel a <br />distance of over 60q} feet from LOt 6 through this swale onto Andrie Street. Under Spring melt <br />conditions, snow an~ice can be expected to impede this overflow. <br /> <br />Recommendatiom <br /> <br />City Staff recommepds denial of the grading permit. However, if the Commission is inclined to <br />recommend approv~ of the grading permit as proposed or upon a revised grading plan, then a <br />conditional use permit has been drafted for consideration. <br /> <br /> Commissio'.a Action: <br /> <br />Motion to: <br />Recommend ithat City Council adopt Findings of Fact <br />for a conditirSnal use permit to grade and export soils. <br /> <br />relating to North Fork's request <br /> <br />Motion to: : <br />Recommendlthat City Council deny North Fork's request for a conditional use permit to <br />grade and ex.l~ort.~ soils based on the findings of fact. ~ <br /> <br /> <br />
