Councilmember ~ introduced the following resolution and moved for its adoption: A RESOLUTIO~ REQUEST FR O~,~I FOR GRADING',' RESOLUTION #95-06- ADOPTING FINDING OF FACT # RELATING TO A NORTH FORK, INC. FOR A CONDIT'i'TFONAL USE PERMIT WHERE~S, the City of Ramsey received an application from North Fork, Inc. for a conditional use pe ~rt~ait for grading on the property legally described as follows: Lots 5, 6, :7 and 8, Block 3, NORTHFORK LINKS ADDITION, Anoka County, Minnesota. (the "Subj~t Property") NOW THEREFI)RE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RA1V[SEY, ANOKA COUNTY, STATE OF MINNESOTA that the findlngs of fact ,;elating to the request are determined to be as follows: 1. That on M~ty 16, 1995, North Fork, Inc., hereinafter referred to as "Applicant", has properly apl flied for a conditional use permit to grade soils in the Northfork Planned Unit Developme .t District. 2. That the ap~Iicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on June 6, 1995, and that said public hearing was properl~ advertised and that the minutes of said public hearing are hereby incorporated as a part of these f'mdings by reference. 3. That the subject property is located in a residential area of a Planned Unit Development and is approximately 8 acres in size. 4. That Sectio'3a 9.11.18 (Grading, Mining and Filling Permits) states that a conditional use permit shall be required to grade individual lots by more than 3 feet in depth, fill individual lots by mor~ than 2 feet at any point, and excavate more than 400 cubic yards of earth 7 8. 9. 10. 11. That the gr~g plan submitted proposes to regrade the Subject Property to create walkout building site~.g sites. That the Apl~licant is proposing regrade ~e s,ubject property to raise the front elevation of the building[pads from 880/882' to 887/888. That no mat6rials are proposed to be imported to or exported from the site. That no blasting will be employed in the grading activity. That no excavation will take place within the road right-of-way. That the gra~ng plan indicates that an 879.8' elevation will be maintained along the lot line between Lot.4 7 and 8 to ensure drainage to a catch basin located along Andrie Street. That the proposed use will/will not be unduly dangerous or otherwise detrimental to persons resi ~djng or working in the vicinity of the use or to the public welfare.
