Councilmember , introduced the following resolution and moved for its adoption: <br /> RESOLUTION NO. 95-06- <br /> <br />A RESOLUTION DECLARING TERMS OF CONDITIONAL USE PERMIT, <br />BASED ON FINDINGS OF FACT # , TO GRADE SOILS <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 95-06- adopting <br />Findings of Fact # i . for this use and-herein approves the Conditional Use Permit subject to the <br />following conditionS. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, A~qOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On , 19~fl, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to North ~ork, Inc. ("Permit Holder") for grading operations on the property legally <br />described as followS: <br /> <br /> Lots 5, 6, ? and 8, Block 3, NORTH FORK LINKS ADDITION, Anoka County, <br /> Minnesota. <br /> <br /> This permit is issu,gd pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br /> conditions of this ~,p~rmit are as follows: <br />1. This permit Shall expire on ,1995. <br /> <br />2. All grading ~hall be in conformance with the grading plan dated and prepared by <br /> <br />3. All equipment used for grading operations shall be maintained and operated in such a <br /> manner to n~inimize noise, dust, and vibrations adversely affecting surrounding properties. <br /> All equipmegt shall be kept in good repair. Failed equipment and rubbish shall be removed <br /> from the wot~ksite regularly. <br /> <br />4. All worksite$ shall be properly safeguarded to prevent the general public from depositing <br /> garbage or other refuse on the worksite. <br /> <br />5. Existing tree;.and groundcover shall be preserved to the extent feasible. <br /> <br />6. Grading operations shall be conducted in such a manner to minimize interference with the <br /> surface wate~ drainage outside the boundaries of the operation. <br /> <br />7. No grading 6perations shall occur at below an elevation of 6 feet abOve the elevation of the <br /> water table o~ the.worksite. <br /> <br />8. Fencing may/be ordered by the City Council or City Engineer anytime the permit is in force <br /> and shall be installed within 24 hours of written notice. <br /> <br />9. All access ro'ads to and from the Subject Property shall be maintained in order to minimize <br /> dust. ' <br /> <br />10. <br /> <br />No gradng operation shall be conducted closer than 30 feet to the right of way line of any <br />existing or platted street, road or right of way. <br /> <br /> <br />
