by ordinance ~fter a public hearing, affirmatively voted to <br /> vacate that ~ertain area designated and dedicated as park in the <br /> plat of White Pine Estates, contingent u~on the execution of this <br /> Develo~ent A~reement, and contingent upon the City Charter <br /> requirements 'as to the effective date of City Ordinances. A <br /> certified co~ of the City's ordinance, vacating the subject <br /> property, when and if said ordinance becomes effective, shall be <br /> made available to the Developer for recording. The Developer <br /> shall cause .~o be obtained a quit claim deed from Thomas W. <br /> Anderson and ~aula E. Anderson, husband and wife, the dedicators <br /> of said park and also the owners of 100% of the abutting property <br /> on said park, conveying all their right, title interest and <br /> equity in and. to said park, in fee, to the City. In addition, <br /> pursuant to p~ragraph 3, Developer shall provide proof of escrow <br /> of the sum of $5100.00, representing a purchase price as noted <br /> in paragraph Se below for the ultimate disposition of said park. <br /> <br /> c. Dona~ion_of__O~tlots Developer shall, upon execution <br /> <br />of this Development Agreement, and contemporaneously with <br />execution of ~he plat, execute quit claim deeds donating to the <br />City, in fee, Outlot A, Outlot B, Outlot D, and Outlot E, Rum River <br />Hills, subject only to the condition that said parcels be utilized <br />for public recreational purposes consisting of a golf course and <br />ancillary usages, whether in public or private ownership (see <br />Exhibit C attached for form of restrictions to be imposed by <br />City). <br /> <br /> d.
