Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-06- <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A <br />REQUEST FROM NORTH FORK, INC. FOR A CONDIT-'Ti-ONAL USE PERMIT <br />FOR GRADING <br /> <br /> WHEREAS, the City of Ramsey received an application from North Fork, Inc. for a <br />conditional use permit for grading on the property legally described as follows: <br /> <br /> Lots 5, 6, 7 and 8, Block <br />Minnesota. <br /> (the "Subject Property") <br /> <br />3, NORTHFORK LINKS ADDITION, Anoka County, <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact relating to the request are determined to be as follows: <br /> <br />That on May 16, 1995, North Fork, Inc., hereinafter referred to as "Applicant", has <br />properly applied for a conditional use permit to grade soils in the Northfork Planned Unit <br />Development District. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on June 6, 1995, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these f'mdings by reference. <br /> <br />That the subject property is located in a residential area of a Planned Unit Development and <br />is approximately 8 acres in size. <br /> <br />That Section 9.11.18 (Grading, Mining and Filling Permits) states that a conditional use <br />permit shall be required to grade individual lots by more than 3 feet in depth, fill individual <br />lots by more than 2 feet at any point, and excavate more than 400 cubic yards of earth <br />material. <br /> <br />That the grading plan submitted proposes to regrade the Subject Property to create walkout <br />building sites.g sites. <br /> <br />That the Applicant is proposing regrade the subject property to raise the front elevation of <br />the building pads from 880'/882' to 887'/888'. <br /> <br />That no materials are proposed to be imported to or exported from the site. <br /> <br />That no blasting will be employed in the grading activity.. <br /> <br />That no excavation will take place within the road right-of-way. <br /> <br />10. <br /> <br />That the grading plan indicates that an 879.8' elevation will be maintained along the lot line <br />between Lots 7 and 8 to ensure drainage to a catch basin located along Andrie Street. <br /> <br />11. <br /> <br />That the proposed use will/will not be unduly dangerous or otherwise detrimental to <br />persons residing or working in the vicinity of the use or to the public welfare. <br /> <br /> <br />
