This financial guarantee may be used by the City to pay <br />for the cosl and expense of repairing any public right of ways due to the mining operation, <br />pay for an3 cost associated in administering the requirements of this Chapter of the City <br />Code, and~ to pay for any restoration of the worksite not properly restored upon <br />completiom <br /> <br />The Penni~ Holder shall implement sediment and erosion control practices. No grading <br />activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed <br />along the p~operty line to prevent sediment from washing onto the adjoining property. Any <br />erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a <br />property lide shall be regraded within forty-eight (48) hours of the precipitation event that <br />caused the i~rosion. <br /> <br />There shall be no stockpiling of graded materials, other than the topsoil on a tempoary <br />basis, allov~ed within the boundaries of the P.U.D. <br /> <br />The permit iholder shall file with the City a liability insurance policy or certificate of such <br />insurance a~ceptable to the City and issued by an insurance company authorized to do <br />business in the State of Minnesota. <br /> <br />ao <br /> <br />The poi,icy shall insure the permit holder for the sum of at least $300,000 for injury to <br />one per~on and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br />bo <br /> <br />Said pokey, shall be for the full period of the permit and shall p. rovide for the giving of <br />10 days~ prior notice to the City by registered mail of ternunation, cancellation or <br />amendment of the policy. <br /> <br />In the e~ent said policy is terminated for any reason, the permit shall be automatically <br />suspend,&l upon the day the policy terminates unless a new policy complying with this <br />item is obtained and filed with the City prior to the termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the worksite shall be within the limits set by <br />the Minnesrita Pollution Control Agency and the Environmental Protection Agency of the <br />United Statds. <br /> <br />All mining o~._ erations shall be conducted in accordance with the grading plan dated May, 1, <br />1995. No more than one (1) acre of disturbed area shall be permitted at any time. <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the permit holder. The permit holder Shall maintain a minimum Five <br />Hundred Dollar ($500.00) balance in. an escrow accOunt with the City. This escrow shall <br />be used to re~lmburse the City for expenses incurred in the administration of this permit. At <br />the time the grading' operation and site restoration are completed to the satisfaction of the <br />City, the bal~ce of the escrow shall be returned to the Permit Holder. <br /> r <br />Ali grading Operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only <br />unless othenCse specifically approved by the City Administrator and/or his designee. <br />The amount ~f dust or other particulate matter caused by the mining operation shall not <br />exceed the st~tndards established by the Minnesota Pollution Control Agency. No operation <br />shall be allowed when wind gust exceed 30 miles per hour. <br /> <br /> <br />
