CASE # 2.. <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT <br />SOILS; CASE OF GOOD VALUE HOMES, INC. <br /> By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On July 20, 1995, the City received an application from Good Value Homes, Inc. to grade and <br />export soils from wbat is proposed to be platted as Chestnut Ridge 2nd Addition. Chestnut Ridge <br />2nd Addition received preliminary plat approval from the City on August 22, 1994 and consists of <br />65 acres proposed to be subdivided into 72 single family lots. The purpose of the project is to <br />create more attractive building sites. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Grading Plan <br />Proposed f'mdings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />Conditional Use Permits are required to be subjected to public hearings with all properties within <br />350 feet being notified of the public hearing. In this case, Staff attempted to notify all property <br />owners within 600 feet of the subject property and all persons along the haul route that would be <br />approved by the City. <br /> <br />Observations: <br /> <br />The applicant is proposing to strip the topsoil, remove and export approximately I5,000 cubic <br />yards of materials, and replace the topsoil. The applicant has proposed that the material would be <br />removed from the site by hauling belly dumps south on Potassium Street N.W. and west on 145th <br />Lane and Sunfish Lake Drive to Sunfish Lake Blvd. The applicant has proposed that empty trucks <br />would return to the site by going north on Tungsten Street N.W. off of County Road #116, east on <br />143rd Lane and north on Potassium. Because of the substantial numb0, r of homes existing on the <br />proposed ingress route, City Staff is recommending that the only haul route be that which has been <br />proposed by the applicant as the egress route. <br /> <br />Staff would recommend that the grading and hauling operation be confined to a four week period <br />from start to finish. <br /> <br />Silt fence and other erosion control measures have been proposed to protect adjacent properties. <br />The revised grading would not affect existing drainage patterns. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the permit. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt Resolution g95-08-__ adopting Findings of Fact <br /># relating to Good Value's request for a conditional use permit to grade and export <br />soils. <br /> <br />'7 <br /> <br /> <br />
