THE ZONING REPORT <br /> <br />Page Eight <br /> <br />tended to a necessary depth of water (typically 10 ft) for reasonable draft navigability, <br />all subject to pierhead, navigational and channel lines in the waterbody. Marine sanitation <br />facilities and their standards of design, capacity and location must be met~ with capacity <br />related to the number of wet slips in th4 marina; sanitation pump-out facilities must be <br />provided and pump-out service must be provided at minimal periodic times (typically, at <br />least weekly) to clear holding tanks. Land sanitation facilities (rest rooms and lavatories) <br />are provided as normally required by the building and health codes. Solid waste deposit <br />containers and dumpsters must be provided to accommodate land facilities and the number <br />of boat slips provided. Marine fuel and service stations are allowed, subject to state wa- <br />ter quality and fire safety standards, to be reviewed and approved by the Fire Chief. <br />(b). Industrial uses include waterfront storage and cargo handling facilities~ warehouses <br />and open storage, berthing facilities and associated support facilities~ truck and rail team- <br />ing areas and transfer tracks and terminals~ water-using manufacturing or processing facil- <br />ities and other manufacturing/processing uses which must be near waterbodies based on <br />essentiality of production costs~ or be dangerous or unsafe unless next to waters. <br />(c). Water-oriented amusements: use and enjoyment of boats, balloons, seaplanes, water-ski <br />tows, parasail tows; sale/rental of watercraft and equipment~ jet skis~ parasails, transport- <br />ers~ windsurfing equipment~ cabanas and cabana and nautical equipment, beach furniture~ <br />and other similar activities may be permitted on land or, by special approval, on piers and <br />wharves seaward of either the shore yard setback or the shoreline. <br />(d). Other u.~es include: any use involving tie-up of boats and vessels; uses separately de- <br />scribed (since they are allowed in different zones) for commercial vessels~ passenger ves- <br />sels, cargo vessels, personal fishing boats and live-aboards and houseboats; piers, commer- <br />cial beaches, multi-access or community piers (which are subject to special standards in <br />the zoning code for keyhole or funnel development for lots with waterbody frontage), and <br />recreational facilities, boathouses, wet boat sales, service and repair~ drydocks and dry- <br />dock boat and apparatus sales and services. <br /> <br />C. Water-related uses. They are allowed as conditional principal uses and as by-right accessory <br />uses to water-oriented principal uses; they may include temporary docking for customers. They <br />include: bait and tackle shops; marine photography, graphics and movie studios; marine oriented <br />public institutions associated with waters, such as aquariums; boat parts store including wet-boat <br />installation; dry-boat storage; gift and souvenir shops, laundries and dry cleaners, laundromats <br />and restaurants; sale of marine fuel and lubricants; sale, service, repair and rental and boats, <br />motors and marine/boat apparatus and hardware; accessory uses of hotels and residential uses, as <br />cabanas, decks, swimming pools and underground utilities. In some residential zones, specified <br />accessory uses to dwellings might be allowed for commercial fishing equipment storage for use by <br />,~ommercial fishing boats licensed to residential occupants with marine products licenses. <br /> <br />D. Water-oriented uses specially restricted or prohibited along shorelines. Manure stockpiles, <br />feedlots, confined pasturage and industrial type animal husbandry (which are defined as not being <br />conventional agricultural activities); mining, sanitary and solid waste landfills, earth landfills, <br />outdoor stockpiles of chemical 'powders and substances; petroleum, liquids and powders stored in <br />tanks must be stored beyond specified setbacks from shoreline boundaries and may be required to <br />contain spillage containment dikes. Uses that draw from underground water sources might be pro- <br />hibited at certain distances individually determined for each proposed site, perhaps requiring lo- <br />cation several miles inland, ~rom oceans, other salt or brackish waters, tidal estuaries and river <br />reaches to prevent salt water intrusion into freshwater underground watertables. <br /> <br />July 21, 1995 issue <br /> <br /> <br />
