9.5 0.0 3 Preliminary plat. <br /> <br /> Subdivision 1. Procedure. Prior to dividing any tract of land into <br />two or more lots or parcels of land, the following procedures shall be followed: <br /> <br /> a. The subdivider shall file five copies of the preliminary plat with <br /> the zoning officer at least ~ 21 calendar days before the next <br /> regular monthly meeting of the Planning Commission at which <br /> meeting said plat shall be considered and at which time the <br /> required public hearing may be hekk <br /> <br /> c. The zoning officer shall refer copies of the preliminary plat to the <br /> Planning Commission and one copy to the city engineer. <br /> <br /> d. The city engineer and the zoning officer shall submit a <br /> report to the Planning Commission before the public hearing, <br /> which shall deal with drainage, s~¢et and other engineering <br /> matters, land use, lot sizes and dimensions, and other <br /> matters pertinent to said preliminary plat. <br /> <br /> e. The Planning Commission shall hold a public hearing on said <br /> preliminary plat. Notice of public hearing shall be published in <br /> the official newspaper of the city and sent to property owners <br /> within 350 feet of the property to b~ subdi¥ided at least ten days <br /> prior to the hearing date. Public notice shall consist of a general <br /> description of the proposal, the time, date and place of hearing. <br /> For the pLLrpose of notification, ownership of property within <br /> 350 feet shall be determined by records on file in the ~ <br /> assesseias Anoka County GI$ office. In case the plat is <br /> disapproved, the subdivider shall be notified of the reason for <br /> such action. The notices and publications as required hereunder <br /> shall be done by the zoning officer and shall be paid by the <br /> subdivider. The Planning Commission shall conduct the hearing <br /> on the preliminary plat and shall make its report to the Council at <br /> its next me~ting which falls at least 44 '7 days after the Planning <br /> Commission's public hearing. It shall be the duty of the <br /> Planning Commission to determine whether the preliminary plat <br /> conforms with or exceeds the design standards established by <br /> this chapter. The d~ision of the Planning Commission with <br /> regard thereto, together with its recommendations, shall be <br /> included in its report To the Council. <br /> <br /> f. After the Council receives the report of the Planning <br /> Commission, the council shall act to approve or disapprove the <br /> preliminary plat. If the council shall disapprove said plat, the <br /> grounds for any such disapproval shall be set forth in the <br /> <br /> <br />
