Scenic River § 9.23 <br />9.23 ~cenic River <br /> <br />9.23.0 1 policy and authorization. A section for the controlling of bluffiand and <br />riverland development in order to protect and preserve the outstanding scenic, recreational, natural, <br />historical, and s~nic values of the Rum River in Ramsey, Minnesota, in a manner consistent with <br />Minnesota Sta~tes, §103F.301 - 103F.345, MN Rules, parts 6105.0010 - 6105.0250, and MN <br />Rules, parts 610~.1400 - 6105.1500. <br /> <br />9.23.02 Title. This section shall be known, cited, and referred to as the Scenic River <br />Section; except ~s referred to herein, and where it shall be known as, "This Section". <br /> <br />9.23.03 SCope and interpretation. <br /> Si~bdivision 1. The provisions of this section shall apply within the designated <br />Scenic River Lagd Use District of the Rum River, in accordance with the property descriptions <br />contained in ~ Rules, parts 6105.1400 - 6105.1500. <br /> S~abd. 2. In their .interpretation and application, the provisions of this section <br />shall be held to be minimum requirements, and shall not be deemed a limitation or repeal of any <br />powers or rights granted by Minnesota Statutes. <br /> Sobd. 3. It is not intended by this section to repeal, abrogate, or impair any <br />existing easemeat, covenants, deed restrictions, or land use controls. Where this section imposes <br />greater restrictions, the provisions of this section shall prevail. <br /> Sobd. 4.. Compliance. The use of any land within the Scenic River Land Use <br />District; the size Iand shape of lots; the use and lo.cation of ~tmcmres on lots; the installation and <br />maintenance of ~ater supply and waste disposal facilities; the filling, grading, lagooning, or <br />dredging of any ~ver area; the cuffing of vegetation or alteration of the natural topography within <br />the district; and tile subdivision of land shall be in full compliance with the terms of this section and <br />other applicable/~egulations. Permits from the Zoning Authority are required by this Section, for <br />the construction bf buildings, public or private water supply and sewage treatment systems, the <br />grading and fillin[g of the natural topography, and erection of signs within the Scenic River Land <br />Use District of thl~ Rum River. <br /> <br /> Sqbd. 5. Definitions. For the purpose of this section, certain terms and words <br />are defined as follows: <br /> Agricultural Use means the use of land for the production of food or fiber, their <br />storage on the ara, and/or the raising thereon of domestic pets and domestic farm animals. <br /> <br /> Bl!sffiine means a line along the top of a slope connecting the points at which the <br />slope of land becomes more than 12%. This applies to those slopes within the land use district <br />which are beyond!' the setback provisions from the ordinary high water level. <br /> Bt!ilding Line means that line measured across the width of the lot at the point <br />where the main stlmcture is placed in accordance with setback provisions. <br /> <br /> C~mpground means an area accessible by vehicle and containing campsites or <br />camping spots fo~tents and trailer camping.. <br /> Cl~r-cutting means the removal of an entire stand of vegetation. <br /> <br /> COmmissioner means the Commissioner of Natural Resources. <br /> <br /> COnditional Use means a use of land which is permitted only when allowed by <br />the Council after ~ public hearing if certain conditions are met which eliminate or minimize the <br />incompatibility M!.th the other permitted uses of the district. <br /> <br /> EsSential Services means underground or overhead gas, electrical, steam or <br />water distributiofi systems; collection, communication, supply, or disposal systems, including <br /> , qq <br /> <br /> <br />
