DOHERTY <br />RUMBLE <br />& BLrlZER. <br /> <br />Mayor Glen Hardin <br />City Cotmcilmember <br />Septemb.er 20, 1995 <br />Page 2 <br /> <br />To our knowledge there are no residential properties affected by operations at the Bury & <br />Carlson facility and thm-e have been no complaints about the noise or activity levels 'since the <br />use was established. We do not believe there would be any adverse impact on any other <br />property owner by allowing extended hours on a permanent basis. <br /> <br />Condition No. 17(c) requires Bury & Carlson to sweep 143rd Avenue to Jasper Street. Bury <br />& Carlson also asks that this Condition be deleted, primarily for liabi/ity issues. With continued <br />development and construction of the water and sewer project in this area of the City, these <br />streets are used by'a number of businesses and other users who could be responsible for <br />depositing debris on the roadway. Bury & Carlson does not w~t to be liable for failure to <br />sweep up someone etse's debris. Bury & Carlson will conthaue to ensure that trucks leaving its <br />facility do not have loose sand or gravel on them that could be deposited on the street, and. to <br />sweep up any such debris if' they do. However, Bury. & C~rlson would 'prefer not to be <br />permanently responsible for sweeping the streets in this area on a weekly basis. <br /> <br />'We wood appreciate it if this request could be. discussed by the" City Council at its <br />September 20th workshop, and some preliminary indication given as to whether the Council <br />thin. ks it would be reasonable ar/d acceptable to delete these requirement.*.
