This financial guarantee shall be maintained at <br />the City as long as the conditional use permit remains in full force and effect. <br /> <br />15. <br /> <br />The operator of the facility will provide a visual inspection of all trucks and remove any <br />debris fram them prior to the trucks leaving the site, and take precautions to prevent <br />spillage from macks. <br /> <br />16. <br /> <br />The City may initiate action to revoke the conditional use permit in accordance with <br />procedure~ established in the Ramsey City Code. <br /> <br />17. <br /> <br />18. <br /> <br />The failure of the City at any _time to require performance by the perrnittee of any provisions <br />hereof sh~l in no way affect the right of the City thereafter to enforce the same. Nor shall <br />waiver by~ the City of any breach of any of the provisions hereof be taken or held to be a <br />waiver of'.any succeeding breach of such provision or as a waiver of any provision itself. <br /> <br />If any provision of this CUP shah be declared void or unenforceable, the other provisions <br />shall not be affected, but shall remain in full force and effect. <br /> <br />19. <br /> <br />The Permlttee agrees to connect to City sewer and water at the time sewer and water is <br />extended fO the area and herein agrees to join in a petition for such improvements provided <br />such petition is not presented within 7 years of the City's acceptance of the required <br />improvements to 143rd Avenue N.W. and Jaspar Street N.W. However, the Permittee <br />does not f. elinquish their rights under Minnesota Statutes Chapter 429, or Ramsey City <br />Code Chaibter 4, to appeal the amount of the assessments. <br /> <br />20. <br /> <br />The City Administrator, or his/her designee, shall have the right to inspect the premises for <br />compliancO and safety purposes annually or at any time, upon reasonable request. <br /> <br />21. <br /> <br />The Permittee shall be responsible for all City costs incurred in administering and enforcing <br />this conditional use permit. Said expenses shall be paid within fifteen (15) days of billing <br />by the Cit~ and failure to pay the City's expenses within the fifteen (15) day billing period <br />will permit the City to drawn upon any of the escrows required by this agreement for <br />payment. ~'he permittee shall maintain a $2,000.00 balance in an escrow account with the <br />City. Thi~ escrow shall be used to reimburse the City for expenses incurred in the <br />administra.fion of this permit in the event the permittee fails to pay the City expenses within <br />the fifteen[day billing period. The City reserves the right to use these funds to pay for <br />testing serqices as necessary. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br />and the following Were absent: <br /> <br />whereupon said re~olution was declared duly passed and adopted by the Ramsey City Council this <br />the ~ day of ,1995. <br /> <br />Bury and Carlson, !nc. hereby acknowledge receipt of this penrfit and that they have reviewed the <br />conditions of this permit and have agreed that they will cause compliance with the terms of this <br />permit. <br /> <br /> <br />
