CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE, IMPORT AND <br />EXPORT SOILS; CASE OF NORTH FORK, INC. <br /> By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On April 28, 198_7, the City issued a conditional use permit to L&G Rehbein and North Fork, Inc. <br />to grade and exCavate a lake in the Northfork P.U.D. Subsequent to the issuance of that penn/t, <br />the City Code per'raining to grading and mining permits was amended. In April of 1991, the permit <br />was reissued in hccordance with the revised regulations. In August of 1991, that permit was <br />transferred from[L&G Rehbein to Glenn Rehbein. The permit issued to Glenn Rehbein had an <br />expiration date o~ July 31, 1992. <br /> <br />On October 26, 2995, the City of Ramsey received an application for a new conditional use permit <br />for grading, importing and exporting soils in order to complete excavation of the lake area and ' <br />create walkout style home sites. <br /> <br />Noti fi ca tion: <br /> <br />Conditional use .permits are required to be subject to public hearings. State law requires <br />notification of tt/g public hearing to all properties within 350 feet of the subject property. Staff <br />notified all properties within 800 feet of the subject property. <br /> <br />Observations: <br /> <br />The revised grac[ing plan submitted varies from that which was originally approved under the <br />preliminary plat (sf Northfork 5th Addition in order to create the more attractive walkout style home <br />sites. It also reflects an intent to export approximately 820,000 yards of sand from the 80 acre site, <br />two thirds of which is associated with the excavation of the second lake, and import 70,000 yards <br />of topsoil and cle,~ organic material. <br /> <br />The haul road proposed will extend through undeveloped portions of Northfork 5th and the Links <br />golf course weste~rly to the raikoad tracks, then southerly along the raikoad tracks to 153rd. No <br />portions of paved city streets will be used except for the portion of 153rd Avenue between the <br />railroad tracks an~i T.H. glO. <br /> <br />City Code limits~ the time frame for grading permits to 3 years. In this case, North Fork is <br />proposing to expoix the soils off-site as markets appear.
