CASE

REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE, IMPORT AND
EXPORT SOILS; CASE OF NORTH FORK, INC.
By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik

Background:

On April 28, 198_7, the City issued a conditional use permit to L&G Rehbein and North Fork, Inc.
to grade and exCavate a lake in the Northfork P.U.D. Subsequent to the issuance of that penn/t,
the City Code per'raining to grading and mining permits was amended. In April of 1991, the permit
was reissued in hccordance with the revised regulations. In August of 1991, that permit was
transferred from[L&G Rehbein to Glenn Rehbein. The permit issued to Glenn Rehbein had an
expiration date o~ July 31, 1992.

On October 26, 2995, the City of Ramsey received an application for a new conditional use permit
for grading, importing and exporting soils in order to complete excavation of the lake area and '
create walkout style home sites.

Noti fi ca tion:

Conditional use .permits are required to be subject to public hearings. State law requires
notification of tt/g public hearing to all properties within 350 feet of the subject property. Staff
notified all properties within 800 feet of the subject property.

Observations:

The revised grac[ing plan submitted varies from that which was originally approved under the
preliminary plat (sf Northfork 5th Addition in order to create the more attractive walkout style home
sites. It also reflects an intent to export approximately 820,000 yards of sand from the 80 acre site,
two thirds of which is associated with the excavation of the second lake, and import 70,000 yards
of topsoil and cle,~ organic material.

The haul road proposed will extend through undeveloped portions of Northfork 5th and the Links
golf course weste~rly to the raikoad tracks, then southerly along the raikoad tracks to 153rd. No
portions of paved city streets will be used except for the portion of 153rd Avenue between the
railroad tracks an~i T.H. glO.

City Code limits~ the time frame for grading permits to 3 years. In this case, North Fork is
proposing to expoix the soils off-site as markets appear. The applicant is requesting that the permit
be issued for a time frame beyond the 3 year limit.

The following items are enclosed for your information:

a)
b)
c)
d)
e)
0
g)

Site location map
Properties notified map
Applicant's letter, of application
PrOposed grading plan
Prqposed phasing plan
Pro, posed findings of fact
Proposed conditional use permit
