A section for the controlling of bluffland and <br />tent in order to protect and preserve the outstanding scenic, recreational, natural, <br />Lc values of the Rum River in Ramsey, Minnesota, in a manner consistent with <br /> §103F.301 - 103F.345, MN Rules, parts 6105.0010- 6105.0250, and MN <br />,,1400 - 6105.1500. <br /> <br />9.23.02 Title. This section shall be known, cited, and referred to as the Scenic River <br />Section; except as referred to herein, and where it shall be known as, "This Section". <br /> <br />9.23.03 ScOpe and interpretation. <br /> <br /> Subdivision 1. The provisions of this section shall apply within the designated <br />Scenic River LandiUse District of the Rum River, in accordance with the property descriptions <br />contained in MN Rules, parts 6105.1400 - 6105.15130. <br /> <br /> Su§d. 2. In their interpretation and application, the provisions of this section <br />shall be held to belminimum requirements, and shall not be deemed a limitation or repeal of any <br />powers or rights granted by Minnesota Statutes. <br /> <br /> SuRd. 3. It is not intended by this section to repeal, abrogate, or impair any <br />existing easement, iPovenants, deed restrictions, or land use controls. Where this section imposes <br />greater restrictions,ithe provisions of this section shall prevail. <br /> Sub;& 4. Compliance. The use of any land within the Scenic River Land Use <br />District; the size ang shape of lots; the use and location of structures on lots; the installation and <br />maintenance of wa~er supply and waste disposal facilities; the filling, grading, lagooning, or <br />dredging of any riv/er area; the cutting of vegetation or alteration of the natural topography within <br />the district; and the gubdivision of land shall be in full compliance with the terms of this section and <br />other applicable regulations. Permits from the Zoning Authority are required by this Section, for <br />the construction of buildings, public or private water supply and sewage treatment systems, the <br />grading and filling 0f the natural topography, and erection of signs within the Scenic River Land <br />Use District of the Rum River. <br /> Subtl. 5. Definitions. For the purpose of this section, certain terms and words <br />are defined as folloWs: <br /> Agricultural Use means the use of land for the production of food or fiber, their <br />storage on the area, ired/or the rinsing thereon of domeslac pets and domeslac farm animals. <br /> Bluffiine means a line along the top of a slope connecting the points at which the <br />slope of land becon~es more than 12%. This applies to those slopes within the land use district <br />which are beyond th~b setback provisions from the ordinary high water level. <br /> Buil~ling Line means that line measured across the width of the lot at the point <br />where the main structure is placed in accordance with setback provisions. <br /> <br /> Campground means an area accessible by vehicle and containing campsites or <br />camping spots for tents and trailer camping. <br /> Cleat-cutting means the removal of an entire stand of vegetation. <br /> Comlnissioner means the Commissioner of Natural Resources. <br /> <br /> Conditional Use means a use of land which is permitted only when allowed by <br />the Council after a pBblic hearing if certain conditions are met which eliminate or minimize the <br />incompatibility with the other permitted uses of the district. <br /> <br /> Esseatial Services means underground or overhead gas, electrical, steam or <br />water distribution s~stems; collection, communication, supply, or disposal systems, including <br /> <br /> <br />
