Sabd. 4. Procedure. The procedure for making such an appeal shall be as <br /> <br />follows: <br /> <br />The property owner or agent shall file with the City a notice of appeal <br />stating the specific grounds upon which the appeal is made. Said <br />application shall be accompanied by a fee as established by Council <br />resolution. <br /> <br />bo <br /> <br />The Board of Appeals shall make its decision by adopting a resolution <br />stating findings of fact within a timeframe as prescribed by Minnesota <br />Statutes Section 15.99. <br /> <br />9.03.10 <br /> <br />EaSement Vacation. <br /> <br /> Subd. 1. Procedure. The procedure for application to vacate a utility, roadway, <br />access, or other form of easement shall be as follows: <br /> <br />The request for an easement vacation shall be filed with the Zoning <br />Administrator on an official application form. Such application shall be <br />accompanied by a fee and deposit as provided for in §9.03.02. Such <br />application shall also be accompanied by a sufficient number of copies as <br />required by City staff of detailed written and graphic materials fully <br />explaining the request. The request shall be considered as being officially <br />submitted when all the information requirements have been met. <br /> <br />Easement vacation applications must be submitted to the Zoning <br />Administrator thirty (30) days prior to the City Council meeting. <br /> <br />Co <br /> <br />The City has 10 days to determine of the application is complete. In the <br />event that the application is incomplete, staff will notify the applicant within <br />the 1 O-days and provide direction on what information is still required. <br /> <br />Properties located within 350 feet of the applicant's subject property will be <br />notified of the request and public hearing date. <br /> <br />City Staff will prepare a staff report detailing the information related to the <br />request, findings of fact and proposed ordinance. <br /> <br />9.03.11 Application. Where the conditions imposed by any provisions of this Chapter are <br />either more or less restrictive than comparable conditions imposed by any other regulation, the <br />regulations which i~pose the higher standard or requirements shall prevail. From and after the <br />effective date of this Chapter, the use of all land and every building or portion of a building <br />erected, altered in h~ight and area, added to, or relocated, and every use within a building or use <br />accessory thereto, in the City shall be in conformity with the provisions of this Chapter. <br /> <br />9.03.12 Comphanee. No structure shall be located, erected, constructed, reconstructed, <br />moved, altered, converted or enlarged, nor shall any structure or land be used or be designed to <br />be used except and after the lawful issuance of all permits required by this Chapter. <br /> <br />36 <br /> <br /> <br />
